AGENDA ITEM 6F <br />STAFF ORIGINATOR: John Powell, City Engineer <br />COUNCIL MEETING DATE: November 8, 1999 <br />TOPIC: Consideration of Resolution No 99 109, Adopt Assessment Roll, <br />Surfside Addition <br />VOTE REQUIRED: Simple. Majority <br />BACKGROUND: <br />On October 25, 1999, the City Council held a Public Hearing for the proposed <br />assessments for the Surfside Addition. At the hearing, the developer, Mr. Bruce <br />Hanson, objected to the Surface Water Management Charges (SWMC) which for <br />his project totaled $9,365. <br />With regard to these charges, we note the following: <br />1. Consistent with City policy, Mr. Hanson has already received a credit to his <br />SWMC in the amount of $8,055 for subwatershed improvements. <br />2. As the ponds and drainage ways are located in City easements and will <br />require maintenance at some time in the future, the City needs the ability to <br />clean and repair these areas without relying on an assessable benefit to <br />nearby properties, <br />3. The proposed SWMC amount is the same as indicated to Mr. Hanson as <br />early as October of 1997 and is the same as is included in the development <br />agreement for Surfside Addition. <br />4. Section 111 C.3 waives the developer's objection to the special assessments <br />including the claim that the assessment exceeds the benefit to the property. <br />Based on the above information, we recommend the assessments, including the <br />Surface Water Management Charges, be assessed as originally proposed. <br />OPTIONS: <br />1. Return to staff for further review. <br />2. Adopt Resolution No. 99 -109 adopting the assessment roll for the Surfside <br />Addition project. <br />RECOMMENDATION: <br />Staff recommends Option No 2; the adoption of Resolution 99 —109. <br />
