RELOCATION AGREEMENT <br />THIS AGREEMENT, made this day of , 1997, <br />between NORTHERN STATES POWER COMPANY, a Minnesota corporation (hereinafter <br />referred to as NSP) and the City of Lino Lakes (hereinafter referred to as );City <br />WITNESSETH THAT: <br />WHEREAS, the City has requested that NSP relocate a transmission line to <br />accommodate the construction of Otter Lake Road (CR84) in Anoka County, Minnesota <br />(Sections 24, Township 031 North, Range 22 West); and <br />WHEREAS NSP's existing facilities are located on private property, NSP has requested <br />reimbursement of the actual cost it incurs in adjusting said facilities and the City agrees to so <br />reimburse NSP; and <br />WHEREAS, NSP has estimated the cost of this construction to be $21,000. Attached <br />hereto, marked Exhibit "B ", and made a part hereof, is a detailed and itemized estimate of the cost <br />of the work to be performed by NSP in relocating said facilities; <br />Also attached hereto, marked Exhibit "A" and made a part hereof, are detailed plans <br />indicating the facilities involved, their present and proposed location. <br />NOW THEREFORE, in consideration of the mutual covenants and agreements set forth, <br />it is hereby agreed as follows: <br />1. NSP will relocate said electric transmission line in accordance with Exhibit "A" to <br />accommodate the CR84 construction. Any changes in the relocation from that <br />shown on Exhibit "A" will be coordinated with the City. <br />2. The City will pay the actual costs of such construction. Such actual costs shall <br />include the wages (including all fringe benefits) of all employees of NSP devoting <br />time toward design, engineering, construction, administration, or any other activity <br />associated with said project; costs of any necessary right of way; overhead costs <br />associated with surveying, construction and other operations in the field (including <br />but not limited to charges for mileage, equipment rental or cost, etc.); and material <br />cost for all items associated with said construction. The City agrees that said costs <br />include overhead charges based on material and labor costs associated with said <br />project. At the conclusion of this project, NSP will prepare an invoice for all costs <br />using its standard accounting practices and the City agrees to pay same. <br />reloagre.d0C <br />Page 1 of <br />
