RECOMMENDATION <br />Advertising signs are allowed interim uses within the R -BR Zoning District. Staff review <br />reveals that Universal Outdoor Inc. has substantially complied with the City regulations <br />governing advertising signage. Based on this review, we are recommending the nine <br />interim permits for advertising signage be approved with the following conditions: <br />1. Applicant identify the homes nearest to the proposed sign sites and demonstrate <br />compliance with the 750 foot setback. <br />2. Applicant demonstrates that sign No. 1 meets the 1,200 foot setback requirements <br />from the adjoining GB District. <br />3. A separate interim use permit for each affected property. The permit outlined that <br />the signs shall be removed if the site is rezoned or redeveloped to add another <br />principal use. Sign removal shall be the responsibility of the property owner and <br />the applicant. Both the property owner and the applicant shall sign the approved <br />interim use permit. <br />4. In light of the anticipated land use planning along I -35E, we would ask the applicant <br />to reconsider the location and construction of Signs 1 and 2. <br />5. Sign construction plans be subject to review and approval of the City Building <br />Inspector. <br />6. Applicant provide the City with copies of approved off - premise advertising device <br />permits from MnDOT. <br />ISSUE AND ANALYSIS <br />Section V.E.3 outlines the conditions that must be met to accommodate advertising signs <br />within an R -BR Zoning District. <br />Setbacks. <br />1. Must not be within seven hundred fifty (750) radius feet of an existing <br />residential structure or other advertising structure in a non - freeway area. <br />Neither the site plans or the site location plan submitted by the applicant <br />demonstrate the location of the nearest residential structure. The applicant should <br />indicate the locations of the nearest homes in the area and verify that the <br />aforementioned setback is satisfied. <br />
