AGENDA ITEM 5 B (1 & 2) <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: 5/20/98 <br />TOPIC: Collova Addition, Rezoning and Interim MUSA Reserve (Ordinance No <br />07 -98 regarding the rezone and Resolution-Na-98 -69 regarding Interim MUSA) <br />BACKGROUND: <br />This case originally involved a preliminary plat for six (6) single family lots, a <br />rezone from Rural to R -1, and a request for Interim MUSA Reserve for the <br />property known as 250 and 260 Linda Avenue. 250 Linda Avenue was rezoned <br />and given Interim MUSA Reserve by the City Council in the Fall of 1997. This <br />request would involve a replatting of that previously approved request. Staff <br />suggested that the rezone and Interim MUSA Reserve portion of this request be <br />expanded to include all of the property on the north and south side of Linda <br />Avenue between Hodgson Road and Laurene Street. The individual property <br />owners were notified and no objection has been received to a rezone or Interim <br />MUSA Reserve designation on these additional properties other than the desire <br />of the property owners to be Zoned R -1X. I have enclosed past planning <br />reports for Council information that discuss the preliminary plat in more detail. <br />The Planning and Zoning Board held a public hearing on this matter at their <br />March, 1998 meeting. At that time the public hearing was closed and the matter <br />tabled to allow the applicant time to meet with the neighborhood and make some <br />revisions to the grading plan. At the May meeting of the P & Z, following <br />discussion by the staff, developer, neighborhood (including a petition from the <br />adjoining property owners indicating they would prefer and R -1X zoning <br />designation to the origianlly requested R -1), and questions from the P & Z, the <br />Board recommended approval of a rezone from Rural to R -1 X and the allocation <br />of Interim MUSA Reserve for the property on both sides of Linda Avenue <br />between Hodgson Road and Laurene. The preliminary plat was tabled to the <br />June 10th P & Z meeting to allow the applicant time to redraw the plat to meet <br />the R -1X Zoning Requirements. The P & Z indicated that a redrawn plat would <br />be acceptable provided it met the original conditions outlined in the staff report <br />and the R -1X minimum lot and area requirements. NOTE: a redrawn plat will <br />most likely contain only five (5) single family lots. <br />The applicant is now asking for Council approval of a Rezone from Rural to R -1X <br />Single Family and allocation of Interim MUSA Reserve. <br />
