AGENDA ITEM 5 A <br />STAFF ORIGINATOR: Mary Kay Wyland <br />DATE: 6/11/98 <br />TOPIC: Paul Munoz, 55 Ash Street, Variance <br />BACKGROUND: <br />Paul and Dorothy Munoz have resided at 55 Ash Street since the late 1970's and <br />have experienced several changes along Co. Rd. J /Ash Street. Their property is <br />on the north /east comer of Ash Street (Co. Rd. J.) and Baldwin Lake Road. The <br />most recent change experienced was the widening of Co. Rd. J from Hodgson <br />Road to the west. This widening resulted in the condemnation of approximately <br />17' of the Munoz property and the removal of a row of mature evergreen trees. <br />Since the roadway improvement, several property owners across Co. Rd. J., in <br />Shoreview, have installed board on board 6' privacy fences on their rear property <br />lines. With the completion of each fence installation, the noise experienced on <br />the Munoz property has increased. They are now requesting permission to <br />install a similar fence 6; in height. <br />The Munoz property is Zoned Rural and indicated as Single Family on the <br />Comprehensive Land Use Plan. The site is approximately 1.65 acre in size. The <br />requested variance is to allow the construction of a 6' high fence in the front <br />yard. The ordinance currently allows a 4' high fence from the front facade of the <br />dwelling to the front property line and likewise along the front property line. Mr. <br />Munoz has staked out the proposed fence location which will be approximately 2' <br />- 4' from the front property line. <br />For P & Z information, Co. Rd. J.(Ash Street) is identified in our transportation <br />plan as an "A" Minor Arterial and recommended as a four -lane undivided <br />roadway. The current right-of-way is 100'. Current traffic volumes in front of the <br />Munoz residence show 5,800 vehicles per day with a projected volume of 15,000 <br />by the year 2020. Site visibility does not appear to be a problem for traffic <br />turning onto Co. Rd. J. from Baldwin Lake Road as the right -of -way in this <br />location is 60'. <br />
