Following is the criteria established in the Zoning Ordinance that is necessary to <br />review when considering a variance request. <br />A. That the property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />B. That the plight of the landowners is due to circumstances unique to his property not created by <br />the land owner. <br />C. That the hardship is not due to economic considerations alone and a reasonable use for the <br />property exists under the terms of the ordinance. <br />D. That granting the variance requested will not confer on the applicant any special privilege that <br />would be denied by this ordinance to other lands, structures, or buildings in the same district. <br />E. That the proposed actions will not unreasonably diminish or impair established property values <br />within the neighborhood. <br />F. That the proposed actions will be in keeping with the spirit and intent of the ordinance. <br />Staff would suggest that the following circumstances may provide justification for <br />a variance: <br />1. Co. Rd. J. is a heavily traveled roadway <br />2. The front property line has been reduced with the previous road <br />construction <br />3. A natural sound barrier has been removed <br />4. An echo effect has been created with the fences across the roadway. <br />The Planning and Zoning Board reviewed this Variance request at their 6/10/98 <br />meeting and recommended approval of the variance with the condition that site <br />our Engineer review any possible site /distance conflicts Baldwin Lake Road and <br />Co. Rd. J. <br />OPTIONS: <br />1. Approve variance subject to Anoka County Sight Line Standards as they <br />relate to the intersection of Baldwin Lake Road and Co. Rd. J. <br />2. Deny variance. <br />RECOMMENDATION: <br />Option 1 <br />
