PARCEL 17 <br />EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT IS MADE THIS day of ll.I 1998, between <br />NICK H. MANGELSEN & ESTHER A. MANGELSEN, Husband and Wife, fee owners, <br />whose address is 6202 Ware Road, Lino Lakes, Minnesota, (hereinafter referred to as <br />"GRANTOR ", whether one or more), and CITY OF LINO LAKES, Grantee, a municipal <br />corporation organized under the laws of the State of Minnesota, having its principal office <br />located at 1189 Main Street, Lino Lakes, Minnesota 55014 -2123 (hereinafter referred to as <br />"CITY "). <br />1. Consideration and Description. In consideration of the sum of $1.00 and other <br />good and valuable consideration, receipt of which is acknowledged, GRANTOR hereby <br />grants, sells, and conveys to CITY, its successors and assigns, the following perpetual and <br />temporary easements for the purpose of construction, operating, inspection, maintaining, <br />repairing, and replacing street, storm sewer, drainage and utility facilities and improvements <br />in and over lands controlled by the GRANTOR situated in the County of Anoka and <br />described on Exhibit A attached hereto and made a part hereof. <br />PERPETUAL EASEMENT <br />Perpetual easement is described on Exhibit B and shown on Exhibit C and attached hereto <br />and made a part hereof. <br />TEMPORARY EASEMENT <br />Temporary easement is described on Exhibit B and shown on Exhibit C and attached hereto <br />and made a part hereof. <br />The Easement Tract is located at 6202 Ware Road, Lino Lakes, Minnesota 55014 and is <br />legally described on Exhibit A. <br />2. Term of Temporary Easement. This easement shall take effect on March 30, <br />1998, and shall automatically expire on April 30, 1999 unless previously released in writing <br />by the City. <br />3. Ingress, Egress, and Maintenance. The CITY, its employees, contractors, and <br />representatives shall have the right of ingress and egress to and from the Easement Tract for <br />such purposes. Such ingress and egress shall be limited to the easements and to existing <br />public roads, in any, on the premises. Such ingress and egress shall also be limited to the <br />period between the hours of 7:00 a.m. and 7:00 p.m. <br />4. Rights of City. Said easements shall also include: (a) the right to clear the surface <br />of herbage and improvements; (b) the right to store equipment and materials from time to <br />time within the easement. <br />
