JUL -02 -1998 15:23 <br />NXC <br />MEMORANDUM <br />NAC 612 595 9837 P.02/15 <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Mary Kay Wyland <br />FROM: Jeffrey Schaumann / Alan Brixius <br />DATE: 2 July 1998 <br />RE: Lino Lakes - MnDOT Site Plan Review /CUPNariance <br />FILE NO: 194.01 - 98.10 <br />BACKGROUND <br />The Minnesota Department of Transportation (MnDOT) has requested a site plan review <br />for a communications facility to be located at 7525 4th Avenue within the Department of <br />Corrections facility site. The communication facility will include a lattice tower with antenna <br />having a total height of 260 feet, shelter building, an AC backup generator and an LP gas <br />tank. The facility use will be for Emergency Medical Services, the Minnesota State Patrol, <br />MnDOT, other state and regional agencies, with additional capacity for commercial users. <br />ISSUE ANALYSIS <br />Zoning Exemption. Examination of the Lino Lakes Zoning Ordinance reveals that the site <br />is zoned PSP District. Within this zoning district, transmission towers are not an allowable <br />use. Additionally, within the districts that do permit this type of tower, the City limits the <br />height to a maximum of 200 feet. This information was presented to the applicant. The <br />applicant responded by citing Minnesota Statutes § 6.45.27 and MS 16B.61 and MS <br />16B.60 which exempts State agencies making improvement on State owned lands from <br />local development regulations.
