WHEREAS, construction plans for the project have been approved, and Lino Lakes and Anoka County have entered into a joint powers agreement concerning the construction and financing for this project, and; WHEREAS, Hugo recognizes the benefits of the completion of this project to all taxpayers in Hugo, has offered financial assistance for the project at meetings of the 1 -35 W/E coalition, and now commits financial support for the project via this joint powers agreement, and; WHEREAS, Minnesota State Statute authorizes political subdivisions to enter into joint powers agreements. NOW THEREFORE, HUGO AND LINO LAKES MUTUALLY AGREE THAT: 1. Lino Lakes, through its agreement with Anoka County will complete the approved interchange project in accordance with the timelines contemplated under that agreement. 2. Hugo will submit payment to Lino Lakes not to exceed $100,000 within 30 days upon receipt of an invoice for said funds from Lino Lakes. Said invoice may be submitted following the acceptance of bids and after authorization has been given to the contractor to proceed with construction of the project. 3. Said funds shall be used in the construction of the improvements, and the City of Lino Lakes shall provide documentation to the City of Hugo sufficient to demonstrate that the funds have been utilized to construct the interchange. IN WITNESS WHEREOF, Hugo and Lino Lakes have caused this agreement to be duly executed on the day and year first above written.
