• <br />• <br />AGENDA ITEM 6B <br />STAFF ORIGINATOR: Michael Grochala <br />CITY COUNCIL <br />MEETING DATE: January 12, 2009 <br />TOPIC: <br />BACKGROUND: <br />Consideration of Resolution No. 09 -02, Authorizing <br />Execution of an Agreement with RCWD to Cost <br />Share Preparation of Special Area Management Plan <br />The Resource Management Plan (RMP), prepared collaboratively with the Rice Creek <br />Watershed District (RCWD), is an integral component of the city's Comprehensive Plan <br />update. The City worked cooperatively with the RCWD, St. Paul District Corps of <br />Engineers (Corps) and state agencies in the development of the RMP. The RMP was <br />considered and approved September 28, 2008 by the Minnesota Board of Water and <br />Soil Resources, the governing agency for the state Wetlands Conservation Act (WCA), <br />as a Comprehensive Wetland Protection and Management Plan. <br />At the request of the City and RCWD, the Corps is considering use of the RMP for <br />future Section 404 permit decisions in the City of Lino Lakes. Section 404 regulates <br />wetland impacts under the Clean Water Act and is administered by the Corps. The <br />Corps has recommended the preparation of a Special Area Management Plan (SAMP), <br />a tool that has been used occasionally by various Corps districts to provide streamlined <br />and consistent Section 404 permit guidance in areas of abundant or sensitive aquatic <br />resources and anticipated population growth. <br />Completion of the SAMP would provide for streamlined and consistent Section 404 <br />guidance in the city and aid both the City and RCWD in implementing the RMP. The <br />Watershed District is proposing to retain the services of EOR, Inc, which prepared the <br />RMP, to complete the plan. The project budget is $20,000 and proposed to be funded <br />equally by the City and RCWD. The City's $10,000 share would be funded from the <br />Surface Water Management Fund. <br />RECOMMENDATION: <br />Staff is recommending approval of Resolution No. 09 -02. <br />ATTACHMENTS <br />1.
