• <br />• <br />Council Member Reinert introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 09 -29 <br />RESOLUTION APPROVING CHANGE ORDER NO. 2 AND PAYMENT NO. 14 (FINAL) <br />LEGACY AT WOODS EDGE PHASE 3 — STREETSCAPE, PLANTING AND IRRIGATION <br />WHEREAS, pursuant to the resolution of the Council adopted April 24, 2006, awarding the <br />construction contract for the Legacy at Woods Edge Phase 3 — Streetscape, Planting, and <br />Irrigation to Jay Brothers, Inc., and <br />WHEREAS, it is in the best interests of the City to install Streetscape, Plantings and Irrigation <br />improvements as part of the Legacy at Woods Edge - Phase 3 project; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA that: <br />1. Change Order No. 2 and Payment No. 14 (Final) for Streetscape, Plantings and <br />Irrigation Improvements in the amount of $95,575.86 is hereby approved. <br />Julian - Bartell, City 1 Jerk <br />J. B- 'ges:n, Mayor <br />Adopted by the Lino Lakes City Council this 11th day of May, 2009. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Stoltz and upon vote being taken thereon, the following voted in favor <br />thereof: <br />Stoltz, Reinert, Gallup, O'Donnell, Bergeson <br />The following voted against same: <br />none <br />Whereupon said resolution was declared duly passed and adopted. <br />
