• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 1E <br />Julie Bartell, City Clerk <br />October 25, 2010 <br />Consider Adoption of Resolution No. 10 -94, <br />Approving a Premises Permit for the Dead Broke <br />Saddle Club to conduct Charitable Gambling at <br />American Legion Post 566 <br />Simple Majority (3/5 Vote Required) <br />An application for a Premises Permit has been submitted by the Dead Broke <br />Saddle Club. The applicants are Eric Wesman, Chief Executive Officer, and <br />Mark Larson, Gambling Manager. The application requests permission for the <br />Club to conduct charitable gambling at American Legion Post 566, 7731 Lake <br />Drive. Charitable gambling is already in place at that location but the current <br />benefiting organization, the Lino Lakes Lions Club, is no longer interested in <br />operating gambling at that location. <br />The Lino Lakes Code of Ordinances, Section 611, regulates lawful gambling in <br />the city. The code includes eligibility requirements for organizations wishing to <br />conduct lawful gambling. The Dead Brook Saddle Club is eligible because they <br />have at least 15 members that are residents of the city. The code also requires <br />that the police department review and make a recommendation on premise <br />permit applications; the Lino Lakes Police Department has conducted a <br />background investigation and found no information on the principal applicants <br />that would give reason to deny the application. <br />Minnesota Lawful Gambling law requires that the local unit of government <br />approve premise permit applications before such are submitted to the Gambling <br />Control Board for final consideration. Therefore, the City Council is being asked <br />to consider approval of the attached resolution approving the application <br />submitted by the Dead Broke Saddle Club. <br />OPTIONS: <br />1.
