• <br />Park Dedication: The current subdivision ordinance includes park dedication in the amount <br />of $2075 per residential unit, less any land dedication. There is no land dedication needed, as <br />Clearwater Creek Park is nearby. <br />Utilities: Sanitary sewer and water is already in place in 65th Street presently. Both <br />proposed lots must connect to utilities upon construction of new homes. Onsite septic systems <br />must be abandoned according to law. These and other issues discussed in the City Engineer <br />review memo must be addressed to his satisfaction. <br />The Preliminary Plat shows drainage and utility easements, but the easement shown on the east <br />property line of Lot 1 is 10 feet where only 5 feet is required; and there is no easement <br />measurement shown on the north property line of both lots. The final plat shows the correct <br />dimension for all of the drainage and utility easements required by the city. <br />Grading: The grading plan has been reviewed by the City Engineer and his comments will <br />need to be addressed to his satisfaction prior to the City Council review of the application. <br />The Planning and Zoning Board approved the Preliminary Plat for the Byrne Langer Addition on <br />May 14, 2008 by a vote of 6 -0. <br />RECOMMENDATION <br />Adoption of Resolution No. 08 -87, approving the Preliminary Plat, Byrne Langer Addition, <br />• subject to the following conditions: <br />1. All lots in the plat, including the existing home, must agree to connect to City <br />utilities. The City will not approve the final plat without legally enforceable <br />assurance that all properties will connect and existing onsite septic systems will be <br />appropriately abandoned. <br />2. Existing wells shall be capped when required by Minnesota Dept. of Health <br />requirements. <br />3. Issues discussed in the City Engineer review memo must be addressed to his <br />satisfaction. <br />• <br />4. A development agreement between the city and the developer must be executed <br />prior to the issuance of any building permits for the site. <br />5. Park dedication must be paid in accordance with the city's fee schedule. <br />6. The Rice Creek Watershed District must review the project prior to building <br />permits being issued by the city for any new construction. <br />7.
