• <br />STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />AGENDA ITEM 6C <br />Michael Grochala <br />August 25, 2008 <br />Consideration of Resolution No. 08 -95, Accepting <br />Land Conveyance, Parcel 15 ROW Plat No. 1, State <br />of Minnesota. <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />In 1992 the City Council authorized the acquisition of property for the purpose of <br />constructing Apollo Drive through what is now the Apollo Business Park. City Right -of- <br />Way Plat No. 1 identified the parcels to be acquired. Parcel 15 of the plat is owned by <br />the State of Minnesota and is part of the Lino Lakes Correctional Facility property. In <br />1993 the City acquired a permanent easement for street and utility purposes over <br />parcel 15. The permanent easement includes a triangular area that lies south of the <br />physical roadway improvements. <br />In January of 2008 both the City and State were notified by the property owner at 400 <br />Apollo Drive that their northeastern driveway access was located on State property <br />encumbered by the City's easement. Since there was no easement or agreement of <br />any kind for the driveway, the attorney for the owner contacted the State to resolve the <br />issue. <br />After reviewing the issue it has been determined that it is in the best interest of the <br />State of Minnesota and the City of Lino Lakes for the State to quit claim its interest to <br />the land described as Parcel 15, City of Lino lakes R/W Plat No. 1 to the City. <br />Following this conveyance the land would become public right -of -way and the driveway <br />issue would be resolved. <br />RECOMMENDATION: <br />Staff recommends approval of Resolution No. 08 -95. <br />ATTACHMENTS: <br />1.
