MEETING DATE: September 22, 2008 TOPIC: Consideration of Resolution No. 08 -105: Fran's Estate • Preliminary Plat Extension of Time • Variance Extension of Time VOTE REQUIRED: Simple Majority BACKGROUND On January 8, 2007 the City Council adopted Resolution No. 07 -01, approving the Preliminary Plat and Variances for Fran's Estate, a two lot residential subdivision on the north side of Birch Street, approximately 150 feet east of Totem Trail. Preliminary Plats are required to be final platted within 12 months, and on November 26, 2007 the City Council adopted Resolution No. 07 -189, which approved a 9 month extension of time for the Preliminary Plat and Variances. Again, the applicant has indicated that he will not be able to meet this deadline. He has requested an additional year to submit the final plat. For the purpose of record keeping and ongoing monitoring of all approvals extended at this time, staff is recommending the deadline be extended to April 31, 2009. The escrow account for Fran's Estate has a balance of $1,077.87 which with this action will be processed for return to the applicant. At the time of final plat a new escrow account will be established per the city's fee schedule. RECOMMENDATION Staff is recommending adoption of Resolution No. 08 -105 approving an extension of the Preliminary Plat and Variance approvals, subject to the following conditions: 1. The complete final plat application for Fran's Estate must be submitted by April 31, 2009; unless an additional extension is granted by the City Council. 2.
