Rosemount, MN 55068 State Project No.: 0280 -55 Contract No. Z07502 Location: In Lino Lakes on CSAH 23 (Lake Dr.) From 1000 ft. south of Town Center Parkway to Apollo Dr. In accordance with the terms of this Contract, you are hereby authorized and instructed to perform the Work as altered by the following provisions. While starting to jack the casing necessary for the work identified in Change Order #7,it was determined that the use of a 42" casing would come into conflict with the 35W pavement. It was therefore necessary for the Contractor to use a smaller casing and different pipe materials. This change required the Contractor to reset their pipe jacking equipment so that the proper grades can be established. As a result the Contractor has claimed that there are costs associated with the initial installation of the 42" casing before the conflict was discovered that are not addressed under the pipe jacking work on Change Order #7. The Engineer has reviewed these claims and determined that some of the claims asserted are valid. This Change Order provides settlement of all claims for the work involved with initially installing the 42" casing. By signing this Change Order the Contractor also acknowledges that the remaining work required to install the 36" casing and pipe will be performed as agreed in the previously issued Change Order #7. *he Contractor will not make claim of any kind or character whatsoever for any other costs or expenses that he may have incurred or that may be hereafter incurred in performing the work and furnishing the materials required by this Change Order. Payment to the Contractor will be at the lump sum negotiated price as full and final settlement of the claims detailed above, as shown below in the Estimate of Cost. In addition, upon review of the steel casing, knuckle and steering sensor, a credit will be applied to this Change Order at the negotiated prices shown below in the Estimate of Prices if it is deemed that the materials can be salvaged by the Contractor.
