Council Member 0' Donnell introduced the following resolution and moved <br />its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 11 -42 <br />RESOLUTION ACCEPTING BIDS AND AWARDING A CONSTRUCTION <br />CONTRACT, 2011 STREET SEALCOAT PROJECT <br />WHEREAS, pursuant to an advertisement for bids for the construction of 2011 Street Sealcoat <br />Project, bids were received, opened and tabulated according to law, and the following bids were <br />received complying with the advertisement: <br />Contractor Amount of Bid <br />Pearson Bros., Inc. $ 94,581.00 <br />Allied Blacktop Company $ 99,754.00 <br />Astech Asphalt Surface $ 101,540.00 <br />Engineer's Estimate $ 108,550.00 <br />AND WHEREAS, it appears that Pearson Bros., Inc. is the lowest responsible bidder; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />1. The Mayor and Clerk are hereby authorized and directed to enter into a contract with Pearson <br />Bros., Inc., in the name of the City of Lino Lakes for the construction of the 2011 Street <br />Sealcoat Project according to the plans and specifications approved by the City Council and <br />on file in the office of the City Clerk. <br />2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the Bid <br />Bonds made with their bids, except that the deposits of the successful bidder and the next two <br />lowest bidders shall be retained until a contract has been signed. <br />Jeff Reinert, Mayor <br />Adopted by the Lino Lakes City Council this 11th day of April, 2011. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council Member <br />Roeser and upon vote being taken thereon, the following voted in favor thereof: <br />The following voted against same: O'Donnell, Rafferty, Gallup, Roeser, Reinert <br />none <br />Whereupon said resolution was declared duly passed and adopted. <br />
