Council Member 0' Donnell introduced the following resolution and moved its adoption: CITY OF LINO LAKES RESOLUTION NO. 11 -42 RESOLUTION ACCEPTING BIDS AND AWARDING A CONSTRUCTION CONTRACT, 2011 STREET SEALCOAT PROJECT WHEREAS, pursuant to an advertisement for bids for the construction of 2011 Street Sealcoat Project, bids were received, opened and tabulated according to law, and the following bids were received complying with the advertisement: Contractor Amount of Bid Pearson Bros., Inc. $ 94,581.00 Allied Blacktop Company $ 99,754.00 Astech Asphalt Surface $ 101,540.00 Engineer's Estimate $ 108,550.00 AND WHEREAS, it appears that Pearson Bros., Inc. is the lowest responsible bidder; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. The Mayor and Clerk are hereby authorized and directed to enter into a contract with Pearson Bros., Inc., in the name of the City of Lino Lakes for the construction of the 2011 Street Sealcoat Project according to the plans and specifications approved by the City Council and on file in the office of the City Clerk. 2. The City Clerk is hereby authorized and directed to return forthwith to all bidders the Bid Bonds made with their bids, except that the deposits of the successful bidder and the next two lowest bidders shall be retained until a contract has been signed. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Roeser and upon vote being taken thereon, the following voted in favor thereof: The following voted against same: O'Donnell, Rafferty, Gallup, Roeser, Reinert none Whereupon said resolution was declared duly passed and adopted.
