• 3) The project intended to be served by the batch plant and a deadline for removal <br />shall be clearly defined. <br />• <br />The Performance Agreement will include a termination date of 10/15/2011 or <br />30 days after the completion of the 135E reconstruction project whichever <br />comes first. <br />4) The Hours of Operation shall be clearly defined. <br />The Performance Agreement will include a clearly defined Hours of <br />Operation. <br />5) Access to and from the site shall be reviewed and approved by the City Engineer <br />prior to any site disturbance. <br />The Performance Agreement will include an approved access plan for the <br />project. <br />6) A grading, erosion and sediment control plan shall be submitted and approved by <br />the City prior to any site disturbance. <br />The Performance Agreement will include references to an approved grading, <br />erosion and sediment control plan. <br />7) A Storm Water Pollution Prevention plan shall be submitted and approved by the <br />City prior to any site disturbance. <br />The Performance Agreement will include references to an approved storm <br />water pollution prevention plan. <br />8) A restoration plan shall be submitted and approved by the City prior to any site <br />disturbance. <br />The Performance Agreement will include references to an approved <br />restoration plan specific to the site. <br />9) All applicable Minnesota Pollution Control Agency requirements are satisfactorily <br />met. <br />The Performance Agreement will include a condition requiring ongoing <br />conformance to the Minnesota Pollution Control Agency guidelines. <br />10) All applicable Rice Creek Watershed District requirements are satisfactorily met. <br />II The Performance Agreement will include a condition requiring ongoing <br />conformance to the requirements of the Rice Creek Watershed District. <br />
