Council MemberRafferty introduced the following resolution and moved its <br /> adoption: <br /> CITY OF LINO LAKES <br /> COUNTY OF ANOKA <br /> RESOLUTION NO. 11-95 <br /> AMENDING THE EXISTING CONDITIONAL USE PERMIT FOR A MOTOR FUEL <br /> STATION AT 7997 LAKE DRIVE TO ALLOW INSTALLATION OF A NEW <br /> CANOPY AND PUMPS <br /> WHEREAS, the City has received an application for an amendment to an existing <br /> Conditional Use Permit for Motor Fuel Station on property currently described to-wit: <br /> THAT PRT OF NW1/4 OF SEC 9 TWP 31 RGE 22 LYG NWLY OF CSAH <br /> NO 23, AKA OLD US HWY NO 8, EX THAT PRT THEREOF DESC AS <br /> FOL: BEG AT INTER OF W LINE OF SD 1/4 & NWLY RAN LINE OF <br /> CSAH NO 23, TH N ALG SD WLINE 329.14 FT, TH N 89 DEG 12 MIN 22 <br /> SEC E 173.34 FT TO SD NWLY R/W LINE, TH S 27 DEG 36 MIN W ALG <br /> SD NWLY RAN LINE 374.11 FT TO POB, EX RDS, SUBJ TO EASE OF <br /> REC <br /> and <br /> WHEREAS, at their meeting on September 14, 2011, the Planning & Zoning Board <br /> conducted a public hearing and recommended approval of the amendment to the <br /> existing conditional use permit subject to the conditions listed in the meeting minutes; <br /> and <br /> WHEREAS, the proposed conditional use permit amendment meets the requirements of <br /> the City's zoning ordinance and subdivision ordinance subject to certain conditions of <br /> approval. <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby <br /> approves the conditional use permit amendment based on the findings in the staff report <br /> and subject to the following conditions of approval: <br /> WHEREAS, the City Council makes the following FINDINGS: <br /> Finding 1.
