STAFF ORIGINATOR: <br />CITY COUNCIL <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />AGENDA ITEM 6C <br />Michael Grochala <br />March 13, 2006 <br />Consideration of Resolution No. 06 -51, Approving <br />Registered Land Survey, SE Quadrant of I -35E /Main <br />Street Interchange. <br />Simple Majority <br />On May 8, 2000 the City Council approved a Conditional Use Permit and Minor <br />Subdivision to allow construction of the east branch of Lino Lakes State Bank, located <br />in the Southeast Quadrant of the I -35E /Main Street Interchange adjacent to Otter Lake <br />Road. The minor subdivision was required to create a new lot for the bank from the <br />existing 30 plus acre parcel. The bank was constructed following City approval and has <br />been in operation for the last five years. <br />In August of 2005 the bank and Richard Schreier, the property owner, brought to our <br />attention that the minor subdivision /lot split had never been recorded. Additionally, in <br />February of 2006 staff was notified that a Registered Land Survey would be required to <br />facilitate the lot split because the property is registered or "Torrens" property governed <br />by Minnesota Statute, Chapter 508. <br />RECOMMEDNATION <br />The Registered Land Survey (R.L.S) submitted for approval creates two Tots - Tract A <br />and Tract B. Tract B represents the bank property as approved in May of 2000 by the <br />City Council. Tract A represents the remainder of the property. The R.L.S. is in <br />conformance with the original lot split approval with the exception of 52 x 543 strip <br />along the north side of Tract A which was acquired by Anoka County for right -of -way <br />purposes. <br />Staff is recommending approval of Resolution No. 06 -51, Approving the Registered <br />Land Survey. <br />ATTACHMENTS <br />1.
