• <br />CITY OF LINO LAKES <br />RESOLUTION NO. 12-59(9,-) <br />RESOLUTION AUTHORIZING AGREEMENT TO MEDIATE <br />I -35E /CSAH 14 IMPROVEMENT PROJECT <br />WHEREAS, in October of 2011 the City Council adopted special assessments against certain <br />real property for the making of the I -35E /CSAH 14 Improvement project; and <br />WHEREAS, in accordance with the provisions of Minn. Stat. § 429, the City received objections <br />to said special assessments from certain property owners who further appealed to the District <br />Court; and <br />WHEREAS, the City has received a request to participate in a mediation process regarding such <br />obj ections. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO <br />LAKES, MINNESOTA: <br />1. The Mayor and Clerk are hereby authorized to execute, on behalf of the City, the Agreement <br />to Mediate prepared by Gregerson, Rosow, Johnson & Lilan, LTD., Attorneys at Law. <br />• Adopted by the Council of the City of Lino Lakes this 2 5 day of JUNE , 2012. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Rafferty and was duly seconded by Council Member Stoesz and <br />upon vote being taken thereon, the following voted in favor th <br />Rafferty, Stoesz, O'Donnell, Roeser <br />The following voted against same: <br />none <br />ATTEST: <br />Juli. e Bartell, Ci <br />Jeff R <br />Whereupon said resolution was declared duly passed and adopted. <br />• <br />ayor <br />
