• <br />P3 lad <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />INTRODUCTION <br />CITY COUNCIL <br />AGENDA ITEM 1L <br />Michael Grochala <br />June 25, 2012 <br />Consider Resolution No. 12 -59, Authorizing <br />Agreement to Mediate, I -35E /CSAH 14 <br />Improvement Project <br />Simple Majority <br />The City has received a request to participate in a mediation process to reach a voluntary <br />agreement with certain property owners regarding special assessments levied for the I -35 /CSAH <br />14 Improvement project. <br />Staff is requesting council approval to enter into an Agreement to Mediate based on the request <br />• of the City Attorney. <br />BACKGROUND <br />The City adopted special assessments in October of 2012 for the I- 35E /CSAH 14 Interchange <br />Improvement Project. During the adoption process the City received objections to the special <br />assessment from certain property owners. In accordance with statutory requirements those <br />property owners have filed those objections with the District Court. Four of the property <br />owners have jointly requested the City's participation in a mediation process. <br />The mediation process is nonbinding but intended to assist the parties in reaching a voluntary <br />agreement and avoiding a more lengthy and costly legal process. The mediation costs will be <br />shared equally between all parties. <br />RECOMMENDATION <br />Staff is recommending approval of Resolution No. 12 -59 Authorizing Execution of Agreement <br />to Mediate. <br />ATTACHMENTS <br />1.
