Right of Way EASEMENTS SITE ZONING VARIANCE APPLICANT believes the appropriate zoning of the site is SC - Shopping Center zoning district to accommodate a wide variety of retail and commercial oriented uses. This gives the city the best level of control over site activity. This development project is consistent with the purpose of the SC zoning ordinance to allow some flexibility in land redevelopment. APPLICANT is also requesting lot area and setback variances for the SC- Shopping Center District. Shopping Center zoning requires minimum lot areas of 3 acres, 50' building setbacks to city streets and does not allow for common walls or zero side yard setbacks at lot lines. Refer to the site plan and preliminary plat. SUBDIVISION APPLICANT is requesting preliminary plat approval. The preliminary plat addresses lot subdivision, right of way dedication, utility and drainage easements, and outlots. In accordance with City Zoning and Subdivision Regulations (Platting), APPLICANT intends to provide land contributions to meet parkland and ROW dedication requirements. (Refer to preliminary plat Outlots A, C, D, F, Apollo Drive and 77th Street Proposed ROW, and yet to be determined Lake Drive ROW dedication) Proposed ROW and Outlot contributions to the parkland and ROW requirements total 11.04 -acre of the total 41.86 -acre or 26% of development land area. APPLICANT will prepare all cross easements, ingress /egress easements and site maintenance agreements for all properties. CONDITIONAL USE PERMIT The APPLICANT is requesting a conditional use for outdoor seasonal sales on behalf of Target Corporation. SuperTarget stores typically have seasonal outdoor sales, such as, spring/sumrner lawn and garden sales and autumn/winter holiday outdoor display and Christmas tree sales, see site plan for location. Per city ordinance, seasonal outdoor sales events require a conditional use permit. The APPLICANT does not foresee any parking stall issues due to the seasonal use of a 40' x100' (22 parking stall) area in the parking lot for seasonal sales.
