• <br />• <br />• <br />Anoka County Contract No. <br />JOINT POWERS AGREEMENT <br />FOR THE RECONSTRUCTION OF <br />COUNTY STATE AID HIGHWAY 23 (LAKE DRIVE) AND I- 35W INTERCHANGE <br />COUNTY PROJECT NO. S.A.P. 02- 623 -13 <br />CITY PROJECT NO. S.A.P. 210 - 020 -04 <br />THIS AGREEMENT is made and entered into this day of <br />2007, by and between the County of Anoka, a political subdivision of the State of Minnesota, <br />2100 Third Avenue, Anoka, Minnesota 55303, hereinafter referred to as "County ", and the <br />City of Lino Lakes, 600 Town Center Parkway, Lino Lakes, Minnesota 55014, hereinafter <br />referred to as the "City ". <br />WITNESSETH <br />WHEREAS, the parties to this agreement agree it is in the best interest of the traveling <br />public to reconstruct the Interchange of I -35W and County State Aid Highway 23 (Lake Drive); <br />and, <br />WHEREAS, said parties mutually agree that the interchange at I -35W and County State <br />Aid Highway 23 (Lake Drive) is in need of reconstruction; and, <br />WHEREAS, Anoka County has jurisdiction over County State Aid Highway 23 (Lake <br />Drive.); and, <br />WHEREAS, the Minnesota Department of Transportation (MnDOT) has jurisdiction over <br />I -35W; and, <br />WHEREAS, the parties have entered into a separate agreement for interchange study, <br />preliminary design and project memorandum (Anoka County Contract No. 2005 -0528) and final <br />design and right of way acquisition (Anoka County Contract No. 2005- 0537); and, <br />WHEREAS, the parties have entered into agreement No. 90500M with MnDOT for <br />signal maintenance at the I -3 5 W ramp termini; and, <br />WHEREAS, the parties agree that it is in their best interest that the cost of said <br />reconstruction be shared; and, <br />WHEREAS, Minn. Stat. § 471.59 authorizes political subdivisions of the state to enter <br />into joint powers agreements for the joint exercise of powers common to each. <br />NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED: <br />1 <br />
