186 <br />Council Meeting <br />May 10, 1982 <br />of the Council that this is a private matter between two land owners and, as such, <br />will have to be settled between themselves. It was suggested that Mr. Scherer <br />contact the DIM on this matter. <br />Mr. McAllister presented the purchase agreement, bond and insurance for a liquor <br />license at the Rocky's North location. <br />Mayor Benson felt that since none of this paper work was in the packets, this Council <br />was not in a position to make a decision at this meeting. <br />1 <br />Mr. Hawkins said he had reviewed all this material and said it was all in order. However, <br />there is the matter of unpaid taxes that must be taken care of and Mr. McAllister is <br />aware of this. <br />There was discussion of the plans for rehabilitating this building and the problem of <br />lighting in the parking lot. Mr. Kluegel noted that this is a non - conforming building <br />and as such., cannot be expanded. However, it is a pre - existing non - conforming building <br />and may continue in the present usage. <br />Mr. McAllister pointed out that his plans for the building cannot be finalized until he <br />has the assurance that a license may be obtained. He also noted that he must do a <br />complete inspection of this building before he can make plans for the remodeling that <br />must be done. <br />Mr. Marier moved to approve this license contingent upon the taxes being paid, all <br />papers in order and fees paid before the license is issued. The motion died for lack <br />of a second. <br />Mrs. Elsenpeter noted that one of her concerns was the inadequate lighting in the <br />parking lot and the fact that the entrance and exit to the parking lot is not clearly <br />marked. <br />Mr. Marier amended his motion to add those requirements. Mrs. Elsenpeter seconded <br />the motion. The motion failed. <br />Mayor Benson called a five minute recess at this point in the meeting. The meeting <br />reconvened. 7:50 P.M./ 8:00 P.M. <br />Mr. Marier moved to accept the application with Mr. McAllister to supply a lighting <br />plan and remodeling plan to the City Building Inspector for his approval, Anoka County <br />Health Inspector's approval and if there are any objections by the residents, a special <br />meeting will be scheduled. Seconded by Mrs. Elsenpeter. The license to be issued when <br />all stipulations are met. Motion carried. <br />ENGINEER's REPORT <br />Mr. Davidson reported on the Watershed Legislation noting the effect this could have <br />on Lino Lakes. No action was taken. <br />80th Street - Mr. Davidson presented the plans for turning this street into a State Aid <br />Road noting that additional right -of -way must be obtained, the bridge rebuilt - he <br />suggested that the paper work be completed on this with work beginning perhaps in 1983. <br />Mr. Davidson was instructed to proceed. <br />Highway #49 Plans - MnDOT is upgrading Highway #49 from County Road J to Lake Drive - <br />there will be 6' shoulders, some turn lanes and an overlay applied. Mr. Davidson had <br />looked at the specifications and had no comment. <br />1 <br />
