October 12, 1982 <br />25 <br />Mrs. Elsenpeter questioned #34, Mr. Robert Smeed, is it necessary that <br />he have a special use permit in view of the new Animal ordinance? <br />Mr. Reinert moved to set a public hearing for the purpose of cancelling <br />No's 1 through 5, and No's 9,45, and 54. Mr. Elsenpeter seconded the <br />motion. <br />She then pointed out that in the case of No. 9, there must be a reason <br />for cancelling a special use permit, and since this matter has been in <br />litagation sirrae the permit was issued, it should not be included. <br />Mr.Hawkins felt that the City is asking for more litagation siiae§=1 the <br />matter of this special use permit is in the hands of the District Court. <br />After some discussion on this matter, Mrs. Elsenpeter withdrew her second, <br />and Mr. Reinert withdrew his motion. <br />Mr. Reinert moved to set a public hearing for consideration of the special <br />use permits that are inactive at this time - No's 1 through 5 for <br />November 22, 1982 at 7:30 P.M. Seconded by Mrs. Elsenpeter. Motion <br />carried unanimously. <br />ENGINEER's RECOMMENDATIONS - FOREST GLEN <br />Mr. Schumacher presented a letter from Mr. Larry Winner recommending the <br />City accept Jeannie Drive in Forest Glen for partial maintenance. Mr. <br />Reinert moved to approve this recommendation. Seconded by Mr. Kulaszewicz. <br />Motion carried unanimously. <br />Partial Acceptance - MarDon Acres - Mr. Winner had recommended Country <br />Lane in MarDon Acres be accepted for partial maintenance. There was some <br />discussion as to the intent of this letter. Mrs. Elsenpeter moved to have <br />Country Lane checked before acceptance for partial maintenance. Seconded <br />by Mr. Reinert. Motion carried unanimously. <br />Forest Glen /Carole's Estates II - Mr. Winner had set forth the amount <br />necessary to complete these projects and should be withheld front the <br />escrow account the City now holds. The total amount to be withheld is <br />$13,000.00 for the completion of these projects to include engineering, <br />leagal and administrative costs. Mr. Schumacher requested authorization <br />to release the funds over and above the $13,000.00. Mrs. Elsenpeter <br />moved to authorize this action. Seconded by Mr. Kulaszewicz. Motion <br />carried unanimously. <br />OLD BUSINESS <br />Loren Law Statement - Mr. Schumacher presented his adjustment of this <br />statement and asked for Council comment. Mayor Benson asked if the $900.00 <br />check that was authorized had been and sent and Mr. Schumacher said, No. <br />Mr. Schumacher felt the Council's concern was with the excessive time <br />spent in review and preparation. The Council felt the entire bill was <br />excessive. <br />Mr. Schumacher went through the areas where he had deducted hours and <br />pointed out the adjustments he had made in the statement with the total <br />cost to be $994.20. <br />
