October 12, 1982 25 Mrs. Elsenpeter questioned #34, Mr. Robert Smeed, is it necessary that he have a special use permit in view of the new Animal ordinance? Mr. Reinert moved to set a public hearing for the purpose of cancelling No's 1 through 5, and No's 9,45, and 54. Mr. Elsenpeter seconded the motion. She then pointed out that in the case of No. 9, there must be a reason for cancelling a special use permit, and since this matter has been in litagation sirrae the permit was issued, it should not be included. Mr.Hawkins felt that the City is asking for more litagation siiae§=1 the matter of this special use permit is in the hands of the District Court. After some discussion on this matter, Mrs. Elsenpeter withdrew her second, and Mr. Reinert withdrew his motion. Mr. Reinert moved to set a public hearing for consideration of the special use permits that are inactive at this time - No's 1 through 5 for November 22, 1982 at 7:30 P.M. Seconded by Mrs. Elsenpeter. Motion carried unanimously. ENGINEER's RECOMMENDATIONS - FOREST GLEN Mr. Schumacher presented a letter from Mr. Larry Winner recommending the City accept Jeannie Drive in Forest Glen for partial maintenance. Mr. Reinert moved to approve this recommendation. Seconded by Mr. Kulaszewicz. Motion carried unanimously. Partial Acceptance - MarDon Acres - Mr. Winner had recommended Country Lane in MarDon Acres be accepted for partial maintenance. There was some discussion as to the intent of this letter. Mrs. Elsenpeter moved to have Country Lane checked before acceptance for partial maintenance. Seconded by Mr. Reinert. Motion carried unanimously. Forest Glen /Carole's Estates II - Mr. Winner had set forth the amount necessary to complete these projects and should be withheld front the escrow account the City now holds. The total amount to be withheld is $13,000.00 for the completion of these projects to include engineering, leagal and administrative costs. Mr. Schumacher requested authorization to release the funds over and above the $13,000.00. Mrs. Elsenpeter moved to authorize this action. Seconded by Mr. Kulaszewicz. Motion carried unanimously. OLD BUSINESS Loren Law Statement - Mr. Schumacher presented his adjustment of this statement and asked for Council comment. Mayor Benson asked if the $900.00 check that was authorized had been and sent and Mr. Schumacher said, No. Mr. Schumacher felt the Council's concern was with the excessive time spent in review and preparation. The Council felt the entire bill was excessive. Mr. Schumacher went through the areas where he had deducted hours and pointed out the adjustments he had made in the statement with the total cost to be $994.20.
