258 <br />July 9, 1984 <br />Mr. Bruggeman is planning on further developing West Oaks of Bald Eagle <br />and this will create additional traffic on this street. The Council will <br />have to decide if this should be a petition project in which case the <br />cost would be assessed to the affected property owners or a maintenance <br />project paid by ad valorem taxes. <br />There was discussion about why this street should be a City street <br />rather than a county road. Mr. Davidson explained that Anoka County <br />never maintained any part of the street and claimed no jurisdiction over <br />it <br />Mr. Volk explained that the day following this meeting he talked to the <br />Director of Ramsey County Public Works and Ramsey County agreed to haul <br />in fill dirt and /or gravel and raise the road slightly and Lino Lakes <br />agreed to come in after this and apply winter mix supplied by Anoka <br />County. <br />Mayor Benson said that although he may have overstepped his bounds, he <br />told Mr. Volk to try to help the residents out until the jurisdiction <br />question could be resolved. <br />Mr. Reinert asked if Anoka County really believes this is a City street. <br />He felt we should meet with our County Commissioner and straighten <br />this out. Mr. Davidson said this street has never been accepted by <br />resolution by the County. Mr. Reinert asked if the City would have <br />some liability if someone gets in an accident on the street. Mr. <br />Davidson said there was more hazard involved in doing nothing. <br />Mr. Davidson offered a compromise solution, Ramsey County apply the <br />gravel lift, Anoka County haul in the winter mix and Lino Lakes use <br />their equipment to compact the gravel. This would take care of the <br />health, safety problem. Mr. Schumacher was concerned this would be <br />setting a precedent and we could be inheriting a substandard street. <br />Mr. Hawkins said the City has an obligation to get this street open to <br />a normal standard. The City will be involved whether we like it or not. <br />Mr. Reinert suggested Ramsey County install the fill /gravel and allow <br />this to be used for a time without blacktop or any work from Lino Lakes. <br />This will allow some time to resolve the jurisdiction question. <br />Mr. Reinert moved the City contact Ramsey County and begin to move in <br />this direction; install sandfill /gravel and allow it to be compacted <br />for a while and the City can work with Anoka. Mr. Marier seconded the <br />motion. Motion passed unanimously. <br />ENGINEER'S REPORT <br />a. Sherwood Green - At the June 25, 1984 Council meeting, Mr. Davidson <br />was requested to contact Rice Creek Watershed District, Anoka County <br />and talk to Mr. LeBlond regarding ditching and ditch cleaning near <br />4th Avenue and the Sherwood Green area. <br />Mr. Davidson presented the Council with a one -page handout status <br />report relative to the feasibility report that was done for 4th Avenue <br />storm drainage program discussed at the last Council meeting.
