018 <br />COUNCIL MEETING <br />June 10, 1985 <br />Page Five <br />and met subdivision regulations and the remaining 61.1 acres also <br />met subdivision regulations and frontage requirements. <br />Mr. Bohjanen moved to approve the division of the Lundgren property <br />into two parcels; 1) parcel E, 16.9 acres with the buildings; 2) the <br />remaining property of 61.1 acres or lots A, B, C, and D, with the <br />understanding that the 61.1 acres can be subdivided in the future <br />as approved by City Council on April 22, 1985. Mr. Kulaszewicz <br />seconded the motion. Motion carried unanimously. <br />C. Bob Rypekma of Schwan Sales and Mrs. Mary Sundell - Mr. Kluegel <br />told the Council that Mrs. Sundell has issued complaints against <br />Schwan Sales because they take delivery of materials between 11:00 <br />P.M. and 7:00 A.M. and the noise interrupts her sleep. Mr. Kluegel <br />has had PCA monitor Schwan Sales for noise levels and during periods <br />of unloading materials the noise reached unacceptable levels. Both <br />Mr. Rypekma and Mrs. Sundell have received copies of these letters <br />from P.C.A. Mr. Kluegel had talked with Mr. Rypekma about reaching <br />an agreement to keep the noise levels down. Apparently the noise <br />continues as Mrs. Sundell still has complaints. Mr. Kluegel asked <br />Mr. Rypekma to attend tonight. He has asked Mr. Rypekma to take <br />deliveries at times other than between 11:00 P.M. and 7:00 A.M. Mr. <br />Rypekma said this was not feasible. <br />Mayor Benson asked Mr. Rypekma what he is doing to control noise <br />levels. Mr. Rypekma explained what happened when the police were <br />last called to check the noise level. Now Mr. Rypekma has instruc- <br />ted his semi truck drivers to turn off the refrigerator portion of <br />the semi truck when exiting 35W at Lake Drive. This should bring <br />the noise level under the 50 decibels required by P.C.A. regulations. <br />Mayor Benson suggested that another reading at night when the semi <br />truck is coming in be taken by P.C.A. <br />1 <br />1 <br />Mrs. Sundell asked if it was possible to use the door on the south <br />side of Schwan Sales. Mr. Rypekma said no, the north door is the <br />only unloading door. Mrs. Sundell said the noise problem is not <br />only the trucks, but banging of boxes, conveyor belt, yelling, scream- <br />ing, and loud music. Mrs. Sundell had a copy of the building applica- <br />tion for Schwan Sales which indicated it was to be a warehouse, not <br />a trucking terminal. Mayor Benson said deliveries once or twice a <br />week would not constitute a trucking terminal. <br />Mayor Benson asked Mr. Kluegel if some sort of barrier could be <br />errected. Mr. Schumacher suggested Mr. Kelso from P.C.A. could <br />make some recommendation along this line. <br />Mrs. Sundell said that the police do have the authority to enforce <br />noise regulations. To date they have not done so. Mr. Kelso said <br />that in not enforcing the regulations, the police are siding with <br />Schwan's or are being selective. <br />1 <br />
