058 <br />COUNCIL MEETING <br />July 22, 1985 <br />Page Five <br />Mr. Marier showed concern over a potential drainage problem <br />which may be caused by the proposed addition. Mr. Marier recalled <br />drainage problems in the past which affected the neighbors to <br />the west of the Tom Thumb. He asked Mr. Kvanbeck if T. F. James <br />Co. would take responsibility for any drainage problems created <br />with the addition. Mr. Kvanbeck stated that he has had his own <br />engineer and also TKDA give opinions on the drainage and feels <br />that there should not be a problem; however, if a problem should <br />arise due to the addition, T. F. James Co. would take responsibility. <br />MOTION: Mr. Kulaszewicz moved to adopt the recommendation of the <br />Planning and Zoning Board to approve the site and building plan <br />from T. F. James Co. of 39481 W. 50th St., for property at 7997 <br />Lake Drive with the stipulations that the drainage and septic <br />system comply with 7/8/85 TKDA memo and are to the satisfaction <br />of the Building Official; the grading and drainage plan comply <br />with the 7/3/85 memo; and the screen consist of five foot at <br />planting pine trees spaced 12 feet on center, or a fence suffi- <br />cient to make at least 50% screen, or a combination of both <br />(to the satisfaction of the Building Official). Another stipu- <br />lation is that should any drainage problems be created by this <br />expansion, the problem will be the responsibility of T. F. James <br />Co. The motion was seconded by Mr. Bohjanen and carried unanimously. <br />The Council took a five minute break. <br />ATTORNEY'S REPORT <br />Mr. Hawkins gave the following suggestions with regard to the <br />contract for planning services with Mr. Zack Johnson /Wuornos <br />& Associates. 1) The contract does not say anything about Mr. <br />Zack Johnson's involvement with City planning. Mr. Hawkins <br />felt this should be included. 2) Paragraph 12 of the contract <br />states that the City could terminate the contract "for cause ". <br />Mr. Hawkins felt that "for cause" is not a good provision. 3) <br />The contract would allow for Wuornos and Associates to subcon- <br />tract without approval. Mr. Hawkins felt the City should have <br />approval of subcontracting. <br />MOTION: Mr. Kulaszewicz moved and Mr. Bohjanen seconded a motion to <br />approve the contract with Wuornos and Associates /Mr. Zack Johnson <br />for City planning services with the three changes recommended <br />by Mr. Hawkins above. Motion carried unanimously. <br />CONSIDERATION OF A PROPOSAL TO CONDUCT THE REVENUE SHARING COMPLIANCE <br />AUDIT FOR 1984 <br />Mr. Schumacher explained that it is a Federal requirement to <br />conduct an audit of revenue sharing programs such as the one <br />
