Studenski, City Engineer <br />COUNCIL MEETING DATE: September 10, 2007 <br />TOPIC: Resolution No. 07 -140, Accepting Petition Against Improvements, <br />Shenandoah Area. <br />VOTE REQUIRED: Simple Majority <br />BACKGROUND: <br />In accordance with the City's Pavement Management Program, the City Council <br />ordered a feasibility study for the reconstruction of the streets in the Shenandoah <br />Area. Also included in the study was the installation of watermain for this area. <br />The City received the attached petition against these proposed improvements on <br />August 30, 2007, from residents and property owners in the Shenandoah Area. <br />Per the City Charter, if a petition is signed by a majority of the owners proposed <br />to be assessed within 60 days of the Public Hearing, the Council shall not make <br />such improvement. The petition has 40 of the 69 assessable property owners <br />signatures (with one questionable), which is approximately 58 %. <br />Following the acceptance of the petition against the improvement, the <br />Shenandoah Project will not be placed on the 2007 Referendum Ballot. <br />Attached is a copy of the signed petition and the receipt of petition against the <br />proposed street, storm water and watermain improvement, dated August 30, <br />2007. <br />RECOMMENDATION: <br />Staff recommends that Resolution No. 07 -140 be adopted. <br />
