66 <br />February 25, 1980 <br />he was aware that some of the lots require five feet and possibly mo, or <br />fill and Mr. Rehbein said he was agreeable. <br />Mr. Marier presented his objections to this plat to include the problem of <br />drainage and the matter of density. He questioned the boring tests - on <br />the number taken the manner ie which they were numbered. He said if <br />there was any additional water flow to his property or any effluent de- <br />rived from this development, he will hold this Council and the developer <br />accountable. He will also take a water flow test, analyze this water and <br />document. He will continue to do this at various times. <br />Mr. McLean asked if this City has made a Tresolution as to WPC -40 - The <br />City is committed to adopting these rules and regulations when they become <br />final. It would seem they have not become final at this point in time. <br />The Council moved into discussion of this plat. Mr. Kulaszewicz was con- <br />cerned with the high water table. He felt this was a problem that could <br />cost the consumer a lot of money. <br />After much discussion, Mrs. Elsempeter moved to approve this plat with the <br />following stipulations: 1) only split entry or ramblers without basements <br />be constructed, 2) pond and weir to be in place before any building permits <br />are issued, 3) roads are to be in and 100% completed before the second phase <br />is started, 4) minimum elevations according to Mr. Gotwald's plan to be <br />maintained. Mr. Jaworski added the requirement 'that all perc tests be <br />taken in the area where the drainfields are to be installed'. The motion <br />and addition was seconded by Mr. Kulaszewica. The motion carried with Mr. <br />Kulaszewicz voting, No. <br />The permit application of the MMTC for renewal on their waste water <br />treatment facility was discussed. The recommendations of the Council was <br />that a public hearing be called for this permit. Mr. Locher prepared a <br />Resloution (see beginning of minutes). Mr. McLean moved to adopt this <br />Resolution. Seconded by Mr. Kulaszewicz. Motion carried unanimously. <br />Mr. Schumacher presented the actions of the Planning and Zoning Board. <br />The first item had been a variance request for a driveway of over 300'. <br />This is necessary due to a lwo spot in the front of the lot. The Planning <br />and Zoning had recommended approval of this driveway. Mr. McLean was con- <br />cerned that this lot, since it contains five acres, could at some point in <br />time, be split into several other lots. The City would then be faced with <br />a short street ending in a cul -de -sac. There was some discussion on this <br />matter. Mr. McLean moved o approve this variance with the stipulations <br />that this driveway is not to be converted to a City street, and the owner <br />must be responsible for the maintenance of the driveway so as to be passable <br />for emergency vehicles at all times. Seconded by Mr. Kulaszewicz. Motion <br />declared passed. <br />The plat of Wollan Estates was considered. The Planning and Zoning Board <br />had approved this plat and recommended a public hearing be set. Mr. McLean <br />moved that a public hearing for Wollan Estates be set for March 24, 1980 at <br />8:45 P.M. Seconded by Mr. Jaworski. Motion declared passed. <br />On considering the request of Mr. Robert Barett to store cars in the rear <br />of his garage, the Council requested that Mr. Barett contact all persons <br />within 300 feet of his property. He is to be on the March 10, 1980 agenda. <br />North NorthEast had presented a sketch for the platting of a portion of the <br />outlots in Lakes Add. #2 & 3. The lots facing Lantern Lane will be platted <br />
