April 28, 1980 <br />Several questions on the disbursements were answered. Mayor Gourley requested <br />that the disbursement checks written for the Board members be presented for <br />approval. Mr, Jaworski questioned the'checks to 'Anoka- Rubber Scamp' this is <br />for printing costs. Mr. Tom Shaughnessy's check was questioned - Mr. Schumacher <br />said tfnfs was overlooked at -the time the checks were written. Mr. Kulaszewicz <br />moved to approve the disbursements as presented, withholding Mr. Shaughnessy's <br />check. Seconded by Mr. McLean. Motion carried unanimously. <br />Under the Open Mike portion of the meeting, Mr. Donald Ma,rier appeared to tell <br />the Council that they are not following the standard rules as set forth for the <br />conduction of a Council meeting. He felt the citzens of the city had elected <br />one individual. "There are certain rules that are put out by the League of <br />Municipalities which the Council has not followed, such as the Mayor opening <br />up a motion, which he may not.do,Secondary to that, call for a motion, didn't <br />get it, then called for a recess at which time, I do not know what took place <br />however, the motion was then presented by a Council person. When you people <br />ran for election, you ran to represent the Citizens of Lino Lakes and it does <br />not appear this is the case today with the exception of two of the older types, <br />I have to take Mr. McLean and Mr. Kulaszewicz out of this. You Gentlemen sit <br />back and relax, I want to talk to the new Council members. You have not done <br />your homework, you don't know what the rules are, you have an Administrator <br />here tonight who says a Council person can change their vote, with no Council <br />action on it, this week a mining permit was issued with no Council action or <br />P &Z action on it. I think it is time you gather yourselves together and start <br />thinking of this community rather than the structure you come into office on. <br />Some of you campaigned that you would have a balance, a balance for all, I don't <br />see that. I served on this Council and I was proud to serve on this Council <br />and I wasn't the easiest Council member in the area and I admit that. However, <br />I think you have an obligation and it's time you look at it. There another <br />situation that youfre.faced with called the Sunshine Law. I think you people <br />have violated that just on your recess sessions. I've cautioned you on that, <br />Mr. Mayor you've been cautioned by the previous Mayor on opening up motions but <br />you continually do that. I would think at this time that you should search <br />yourselves into a situation as to who you are really representing - 1) your- <br />selves or the community. I leave that up to you." <br />Mayor Gourley responded to the matter of the Mayor making and seconding motions <br />this is permissable undef,-the League of Minnesota Municipalities and he did not <br />feel that any member of this Council had violated the Sunshine Law. Mayor <br />Gourley felt the only time you violate the Sunshine Law is when information is <br />kept form the Public and he did not feel any member of this Council was guilty <br />of withholding information from the public. <br />The next item on the agenda was the consideration of Mr. Henry Suchy's special <br />use permit application. Mayor Gourley asked for Mr. Locher's report on this <br />matter. <br />Mr. Locher said that whatever use existed at the time of transfer moy be con- <br />tinued. Mr. Locher read the legal description of the parcel of land and <br />noted the dates of transfer. He noted that the property did not meet the re- <br />quired frontage for a farm classification. <br />Mayor Gourley presented the affadivate from Mr. P. Nadeau which states that <br />only dogs, cats and horses were on the property at the time of the sale. <br />Mr. Jaworski asked, since this matter has -been presented to previous Council, <br />and allowed to continue, what position does this put this Council in?
