Council Minutes . iO3107 <br />May 27, 1980 <br />Mrs. Elsenpeter moved to.grant this special use permit. Seconded by Mr. <br />Kulaszewicz. Mayor Gourley reminded the Council that all abutting property <br />owners must be notified. Mrs. Elsenpeter withdrew her motion until the abutt- <br />ing property owners are notified. Mr. Kulasewicz withdrew his second.i The <br />Clerk is notify all property owners. This item is to be on the June 9, 1980 <br />agenda. Mr. Emly asked that this be put on the June 23, 1980 agenda. Mr. <br />Kulaszewicz so moved. Seconded by Mr. Jaworski. Motion carried unanimously. <br />The next item to be considered was a special use permit reuest by Mr. Sulander <br />for outside storage. Mr. Sulander was not present. He had been told to be <br />present at this meeting. This is the location on Lake Drive where all sorts <br />of materials has been hauled in and dumped and there is no fencing at the pres- <br />ent. Mr. Sulander is proposing to install a four to five foot fence to meet <br />City Codes. <br />Mr. Jaworski noted that ,there are questions; what is being stored? and does <br />not have 2/3's of signatures. He suggested this either be turned down or <br />tabled. <br />The material being dumped is building materials. There was discussion on the <br />requirement of the ordinance on an operation such as this. There was a question <br />of whether a building is being planned at this location. There is no indication <br />of whether this is being planned or not. <br />The general consensus of the Council was this sort of operation is unacceptable. <br />Mn. Jaworski asked, that if an expiration date is part of the special use permit <br />wouldn't it then automatically be void at the end of that period. Mr. Locher <br />agreed. <br />Mr. McLean moved to deny this request. Seconded by Mr. Jaworski. Motion <br />carried unanimously. <br />Mr. Jaworski moved that all this, material be removed within sixty (60) days. <br />Seconded by Mr. McLean. Motion carried unanimously. <br />The next item to be considered was to set a public hearing for the rezoning of <br />Lino Industrial Park. Planning and Zoning had recommended approval of this <br />rezoning of Lots 1 through 6, Block 1, and Lots 1 & 2, Block 2. Mrs. Elsen- <br />peter moved to set a Public Hearing for the rezoning of the above listed lots <br />in Lino Industrial Park for June 23, 1980 at 9:00 P.M. Seconded by Mr. McLean. <br />Motion carried unanimously. <br />The special use permit for Mr. Marcel LeRoux was considered. Mr. Schumacher <br />gave a brief history of the mining operations that have ensued over the past <br />year or so. The Planning and Zoning Commission recommended that Mr. LeRoux <br />present proof of proper frontage, a Letter of Credit to restore the street, <br />$11,787.50) prepare plans for finished grades and existing grades, and plans <br />for the restoration of the property. Also, there must be back payment for the <br />material removed to date. This application had been denied at the last <br />Planning and Zoning Commission. Mr. LeRoux has presented the Letter of Credit <br />and has lined up an Engineering firm to do the surveying and to do the topgraphy <br />of the land. <br />Mr. Gotwald had felt this would be a conflict of interest for him to set the <br />elvations and then inspect them. Mayor Gourley disagreeded. The area that is <br />being worked at the present time must be defined. If this is done, Mr. LeRoux <br />will be permitted to operate in that area only until the topogs are completed. <br />
