Special Council Meeting June 30, 1980 131 I The Special meeting of the Lino Lakes City Council was called to order at 7:30 P.M? on June 30, 1980 with all members present. Mr. Schumacher was also present. The first item on the agenda was consideration of a special use permit application by Mr. Robert Smeed for the keeping of horses on his land on Ware Road. Mr. Smeed owns 2.6 acres and has leased land from two different property owners to give him a total acreage of 5.5 acres. Me. Schumacher presented the report from Mr. Kluegel. 1) the fence will be moved to conform to ordinance - this has been done; 2) the waste will be given to friend; 3) the pond did not have any odor and the septic is over 40' from the pond and the septic system was pumped as maintenance; 4) no problme with teh drainage; 5) construct a wooden shelter under the 1000 square foot size. A letter has been received from Mr. Arnold Kelling. The Clerk was asked to read this letter. Mr. Al Ross had also requested to sepal, He read a prepared statement objecting to this land use. Mayor Gourley asked for comments from the Audience. A gentleman from the audience wanted to discuss this with Mr. Ross. (Mr. Witham) Mayor Gourley asked that the remarks be addressed to the Counci. Mrs. Terry Smith felt there is room for both persons who wanted animals and those who do not. Mr. Suchy asked about his application and Mayor Gourley said he would discuss this with him at the Council recess. Mr. McGrath said he felt that Mr. Smeed had conformed to the Ordinance requirements. Mrs. Elsenpeter said she had several concerns - she pointed out the Ordinance says that a person 'may' be issued a permit - it does not say 'shall'. She felt this is a residential area and that the homes are too clsoe to have horses. She was also concerned about the leases not being renewed and Mr. Smeed would have a lot of money invested in animals, fences, shelter and she could forsee his asking to vary the five acres. Mrs. Elsenpeter felt the parcel containing the five acres should be in one parcel and controlled by the person requesting the special use permit. not in several parcels of alnd subject to other decisions. Mr. Smeed said the building and fence could be taken down and the horses removed. He is well aware of the possibility this permit could be re- voked in one year. Mr. Kulaszewicz agreed with Mrs. Elsenpeter. He was also concerned about the use of the shoulders of the road for riding - the ditches along there are pretty deep. Mr. Smeed said he is not planning on using the road. Mr. Kulaszewicz asked about the pond and Mr. Smeed said when he had this dug it was for a decorative purpose but it didn't turn out the way he and planned. Mr. Smeed said ti was no big deal, he may have it filled.
