1 <br />1 <br />1 <br />099 <br />COUNCIL MEETING <br />May 27, 1986 <br />Page Ten <br />Mr. Hawkins noted he had a meeting with landowners who would be <br />required to give additional easement for the 4th Avenue 'Improve- <br />ments. He was not able to obtain a clear agreement and recommended <br />the Council proceed with eminent domain to obtain the easements. <br />He noted it would take about 120 days under the quick taking law <br />before the City had the right to go onto the property. The costs <br />regarding eminent domain are MSA reimburseable. <br />PUBLIC HEARING, CONDITIONAL USE PERMIT, WILLIAM BOOP <br />Mayor Benson opened the public hearing at 8:56 P.M. Mr. Kluegel <br />explained Mr. Boop's requesting a Land Reclamation permit to haul <br />1,500 cubic yards of sand fill to his residence at 8026 Rondeau <br />Lake Road West to allievate a drainage problem in his back yard. <br />The Planning and Zoning Board has reviewed this request and has <br />recommended approval subject to the following conditions: 1) fin- <br />ish grading plan present no adverse situations to the neighbors per <br />the City Engineer; 2) the proper requirements are met through Corp <br />of Engineers, DNR and RCWD. <br />Mr. Marier moved to approve the Conditional Use Permit. <br />Mr. Beard from the audience said he objected to granting the Con- <br />ditional Use Permit. He is buying the Don Cordie residence to <br />the south of Mr. Boop's property and felt that that amount of fill <br />could cause his property to be flooded. <br />Mr. Hoffman who owns the property to the east of Mr. Boop said <br />water has stood on Mr. Boop's property for at least fifteen years. <br />Mr. Don Cordie, owner of the land to the south of Mr. Boop's, said <br />that if this request were granted it would flood his land. <br />Mr. Boop explained the problems he has regarding his basement be- <br />ing flooded and his septic system failing. He said he would -not <br />flood anyone, he just wants to be able to keep his neighbors from <br />dumping on him. <br />After further discussion Mr. Marier's motion was declared out of <br />order. Mr. Reinert asked that item number two of Mr. Zack Johnson's <br />letter be further clarified and asked that the other agencies <br />present written comment on this matter. <br />Mr. Reinert moved to continue the public hearing since all of the <br />information is not present. Mr. Bohjanen seconded the motion. <br />Motion carried with Mr. Marier voting, no. <br />Mr. Bohjanen moved to set the public hearing at 8:00- P.M. on June <br />9th. Mr. Reinert seconded the motion. Motion carried unanimously. <br />
