100 <br />COUNCIL MEETING <br />May 27, 1986 <br />Page Eleven <br />PLANNING AND ZONING BOARD REPORT - PETE KLUEGEL' <br />A. Variance - Dog Kennel, Jim Hill - Mr. Kluegel explained that <br />Mr. Hill has requested a variance to the grandfather clause of <br />the Kennel Ordinance. The variance would be required because <br />the Hills have less than the required five acres for the Kennel <br />License. The Planning and Zoning Board did review this request <br />and recommended that this request be denied because the Hills <br />have not proved the necessary hardship of the land and also be- <br />cause it was determined that there was no valid pre- existing <br />Kennel at the time of the ordinance change. Mr. Kluegel also <br />noted that the dogs were not licensed at the time it came to <br />his attention that the Hills were violating the Kennel Ordinance. <br />Mr. Bisel called several of Mr. Hill's neighbors regarding whether <br />or not the Hill's dogs were a nuisance. There seemed to be no <br />problem in this area. <br />In view of the fact that the Planning and Zoning Board recommended <br />denial of the request and that the dogs were not originally li- <br />censed, Mr. Bisel moved to deny the variance request. Mr. Marier <br />seconded the motion. Motion carried unanimously. <br />B. First Reading, Ordinance #04 - 86, Wayne Scanlan Proposal - <br />Mr. Scanlan is owner of the White Bear Animal Hospital and is pro- <br />posing to erect an animal clinic with facilities to house large <br />animals for an extended period of time during treatment in the <br />Light Industrial Zone south of the Red Door Antique facilities on <br />Otter Lake Road. The present code does not allow animal clinics <br />as a conditional use in the Light Industrial Zone, thereby prompt- <br />ing this request for a code amendment. Mr. Kluegel explained if <br />this request is granted, Mr. Scanlan will then present a request <br />for a Conditional Use Permit and Site and Building Plan request <br />for the animal clinic. The Planning and Zoning Board did recommend <br />approval of the request. <br />1 <br />Mr. Reinert felt this request was too vague. Did Mr. Scanlan pro- <br />pose to build two huildings? Would large animals be boarded on -site? <br />Since Mr. Scanlan was not present to answer these questions, Mr. <br />Bisel moved to return the request to the Planning and Zoning Board <br />to redefine the intent of the request.
