Anderson, Clerk - Treasurer <br />DEER PASS TRAIL IMPROVEMENT (CONTINUED) <br />1 <br />enson, Mayor <br />Mr. Stahlberg outlined what has happened on this issue to date. A <br />public hearing was held on January 12, 1987 and Mr. Prokop told the <br />Council he had a plan for that area that he wanted to present to the <br />residents. However Mr. Prokop said he was disappointed that nothing <br />was done about his proposal. The residents had tried to resolve the <br />issue in another manner but this also failed. Mr. Prokop said he <br />would like the Council to order the improvement so that this matter <br />did not surface again. <br />Mayor Benson asked Mr. Volk about the condition of the road. Mr. Volk <br />said some maintenance has taken place and the surface is in good <br />condition. Mayor Benson asked Mr. Hawkins what the alternatives were <br />in this situation. Mr. Hawkins said that the road has been accepted <br />by the City, therefore there could be legal ramifications if the Cit <br />were to deny building permits. He suggested there were only two ways <br />to go; 1) order an improvement and complete the roadway or 2) <br />acknowledge that this is an inferior roadway and continue to issue <br />building permits. <br />Mr. Roy Mattson, Deer Pass Trail told the Council about his experience <br />when he applied for a building permit. He felt the entire matter was <br />not handled properly and no building permits should have been issued <br />until the entire road was completed. He said if the road needs to be <br />upgraded, lets get on with it. <br />- Mr. Wayne Ellison, Deer Pass Trail felt since he had purchased a <br />portion of the Jankus property he would also have a vested interest in <br />the road. He also said that he would like the situation to be <br />resolved in one way or another. <br />Mayor Benson asked Mr Hawkins if the road is not finished, can the <br />City force the other landowners to reimburse Mr. Prokop. Mr. Hawkins <br />said the City cannot do this. <br />PAGE 7 <br />
