1 <br />COUNCIL MEETING <br />September 8, 1986 <br />Page Thirteen <br />Benjamin G. Benson, Mayor <br />Marilyn G. Anderson, Clerk- Treasurer <br />D. Sunset Road Six Northerly Lots - Mr. Stallberg noted that there <br />has not been a decision as to what services will be installed in this <br />area and the costs. It was decided that when the Sunset hearing is <br />held on September 22, 1986 the public hearing for the northerly six <br />lots will be continued to a future date. <br />ATTORNEY'S REPORT - BILL HAWKINS <br />Mr. Hawkins did not have a report. <br />CONSIDERATION OF 4TH AVENUE EMINENT DOMAIN APPRAISAL PAYMENTS <br />Mr. Hawkins explained the City will be taking possession of the par- <br />cels taken by eminent domain on September 25, 1986. However, the <br />state law mandates that the City pay for these parcels according to <br />the appraisal prepared by the City appraiser prior to that date. He <br />is requesting authorization to make the payments to the landowners. <br />There is a possibility that some landowners will not accept the <br />amounts set by the appraiser and further court hearings will be neces- <br />sary to complete the litigations. <br />Mr. Marier moved to authorize the payments as requested by Mr. Haw- <br />kins. Mr. Bisel seconded the motion. Motion carried unanimously. <br />Mr. Marier told the Council he had received questions regarding the <br />method used by the appriaser to determine payment and also questions <br />about the ability of each individual parcel to be divided after further <br />easements are taken. <br />CONSIDERATION OF AWARDING SEAL COATING BIDS FOR 1986 ROAD PAVING <br />Mr. Volk advertised for bids for the 1986 seal coat program and had <br />received one bid. He felt this was not a competitive bid and recom- <br />mended that it not be accepted and the 1986 seal coat program to be <br />added to the 1987 program. <br />Mr. Volk was asked why the bid was advertised so late in the year. <br />Mr. Volk explained that the flooding problems and the bad weather <br />during the overlay program has delayed all other projects. <br />015 <br />
