1 <br />1 <br />1 <br />COUNCIL MEETING <br />September 8, 1986 <br />Page Seven <br />Dave Germer - Lots 10 & 11, Golden's Rice Lake Terrace asked what <br />if any benefit will his property receive for this assessment. Mr. <br />Stallberg explained how the utilities are projected to be brought <br />up 2nd Avenue and if his lots are developable the lots will be bene- <br />fited. Mr. Germer explained he was told that the back of his lots <br />are wetlands and not developable. Mr. Stallberg said if they are <br />not developable, there is no benefit and they cannot be assessed. <br />Mr. Stallberg will check the buildability of these two lots. <br />Mr. Ulmer said if the Council could prove a benefit to him he would <br />accept the assessments. Mr. Marier explained again how Mr. Ulmer's <br />subdivision was included in the assessment area and why his proposal <br />was denied until Mr. Ulmer provides the proper easements. <br />Mr. Gearman said he still did not understand his assessment figures. <br />He said he was curious as to how the assessments were spread to the <br />various parcels. Originally the pipes were going to be oversized <br />for future expansion to the north and when those lands were developed <br />the southern developers were going to be reimbursed. Mr. Schumacher <br />explained the project was reduced to serve only the area outlined to- <br />night. <br />Mr. Marier asked Mr. Gearman if his question was how much the pipes <br />were oversized for that area along 2nd Avenue and who is paying for <br />that. Mr. Gearman said, yes. Mr. Marier asked that Mr. Gearman be <br />given the dollar figure for the oversizing and what the end result <br />will be. <br />Mr. Stallberg explained to Mr. Ulmer his assessment consisted of <br />watermain, trunk and sewer and the reason for the assessment is that <br />these services will eventually be extended into his property. Mr. <br />Ulmer commented that his property has not been approved, how can <br />the utilities be extended to service it. Mayor Benson said his <br />property was rezoned and this was at his request. <br />Darrell Shaw, 6800 Lake Drive - Mr. Shaw asked if there are new ad- <br />ditions to these utility lines will the original users be reimbursed. <br />Mayor Benson said no. <br />Mr. Marier moved to close the public hearing at 8:09 P.M. Mr. Boh- <br />janen seconded the motion. Motion carried unanimously. <br />Mr. Marier moved to adopt Resolution #39 -86 to authorize and certify <br />assessments for the Rice Lake Estates area to the County and answer <br />all the questions before the Council tonight. Mr. Bisel seconded <br />the motion. Motion carried unanimously. <br />Mr. Stallberg noted that there is a street assessment on lots 14 & 15 <br />owned by Frank Sazenski (Frankies -on- the -Lake) and Northern Instru- <br />ments. There should not be street assessments and he will revise the <br />assessment. <br />007 <br />
