COUNCIL MINUTES <br />February 23, 1987 Page 1 <br />The regular meeting of the Lino Lakes City Council was called to order <br />at 7:00 P.M. by Mayor Benson. Members present: Bisel, Marier, <br />Bohjanen, Reinert. City Attorney, Bill Hawkins; Engineer, Ron <br />Stahlberg; Public Works Director; Don Volk; Building Inspector, Pete <br />Kluegel, Administrator, Randy Schumacher and Clerk- Treasurer, Marilyn <br />Anderson were also present. <br />CONSIDERATION AND APPROVAL OF MINUTES <br />Special Meeting, February 9, 1987 - Mr. Marier moved to approve these <br />minutes as presented. Mr. Bohjanen seconded the motion. Motion <br />carried unanimously. <br />Regular Council Meeting, February 9, 1987 - Mr. Bisel moved to approve <br />these minutes as presented. Mr. Marier seconded the motion. <br />Mr. Reinert noted that the vote on the motion in paragraph six was not <br />unanimous. Mr. Reinert had voted, No. <br />The regular Council meeting minutes were passed unanimously to include <br />Mr. Reinerts correction. <br />CONSIDERATION AND APPROVAL OF DISBURSEMENTS - FEBRUARY 23, 1987 <br />Mr. Bohjanen moved to approve the Disbursements as presented. Mr. <br />Marier seconded the motion. Mr. Marier questioned if there were <br />funds in the Fire Department budget to cover the costs listed in the <br />Disbursements. He suggested that these costs be allocated to <br />Government Buildings. Motion carried unanimously. <br />OPEN MIKE <br />Marvin Tews, 7919 - 4th Avenue - Mr. Tews explained to the Council <br />that during the reconstruction of the ditches in the 4th Avenue <br />project, the portion of the ditch that runs accross his property was <br />widened and deepened and the area was left in a mess. Also the <br />culvert that was in the ditch prior to reconstruction was removed and <br />not replaced. Mr. Stahlberg explained that the old culvert is too <br />small and would create a dam. If Mr. Tews wishes to replace the <br />culvert he would have to go to Rice Creek Watershed District and apply <br />for a permit and then install it himself. <br />Mr. Tews said he had been to the court house and researched the <br />records regarding the portion of ditch on his property and found that <br />this ditch was a private ditch, not a county ditch. He asked if the <br />City could legally go onto his property and repair a private ditch. <br />Mr. Stahlberg explained that the ditch had been there for a long time <br />and felt it was a proper ditch. <br />1 <br />
