City Council <br />Legacy at Woods Edge <br />March 8, 2004 <br />Rezoning to Planned Unit Development <br />Staff recommends approval of Ordinance No. 04 -04 rezoning the property from LB, <br />Limited Business to Planned Unit Development and approving the corresponding <br />development standards. <br />Development Stage Plan (Preliminary Plat): <br />Staff Recommends approval of Resolution No. 04 -33 Approving the Development Stage <br />Plan and Preliminary Plat subject to the following conditions: <br />The following modifications shall be incorporated into the Preliminary Plat: <br />a. Title work should be prepared to verify the status of existing roadway <br />easements i.e., public or private. If it is determined that they are public <br />easements they shall be vacated in accordance with city and state <br />requirements. <br />2. A development phasing plan shall be submitted for review and approval by the <br />City. <br />3. A feasibility study shall be prepared for the installation of Public Improvements. <br />Such feasibility study shall include estimated costs and proposed assessments to <br />benefiting property owners. <br />Developer shall provide and Economic Feasibility Study of the proposed project <br />for review by the City. <br />5. Developer shall provide an Operation and Maintenance Agreement for the <br />development covering both Public and Private Improvements for review and <br />approval by the City. <br />Developer shall enter into a development contract with the City. <br />7. Acquisition by the City of parcels adjacent to the site required for proposed Lake <br />Drive improvements. <br />8. Requirements for project identity and signage will need to be established in <br />conjunction with final plan /final plat approval. <br />The proposed Lakes Drive improvements will be subject to review and approval <br />by Mn /DOT and Anoka County. <br />ATTACHMENTS <br />Ordinance No 04 -04 <br />16 <br />
