City Council <br />Legacy at Woods Edge <br />March 8, 2004 <br />Development Stacie Plan Approval. <br />Staff makes the following findings with regard to the Development Stage Plan Review <br />Criteria as established in Section 2.8.d of the City's Zoning Ordinance: <br />1. The developer will be required to submit an Operation and Maintenance <br />Agreement to insure adequate property control is provided to protect the <br />individual owners' rights and property values and the public responsibility for <br />maintenance and upkeep of the development. <br />2. The proposed street improvements, including those proposed for Lake Drive, will <br />not create congestion or dangers and is adequate for the safety of the proposed <br />project residents and the general public. <br />3. Open space as required in the development standards is provided. <br />4. The architectural framework as provided for in the design standards will insure <br />compatibility with the surrounding area. <br />5. The drainage and utility system plans are being designed by the City's consulting <br />engineer and are in accordance with city requirements. <br />6. The developer will be required to submit a development schedule to insure a <br />logical development of the site which will protect the public interest and conserve <br />land. <br />RECOMMENDATION <br />The intent of the rezoning to Planned Unit Development and the approval of the <br />Development Stage Plan is to establish the overall regulatory framework, unique to the <br />development, while allowing flexibility for individual site design. It is anticipated that <br />modifications to building size, number and placement will happen as the project <br />develops. However, such modifications will be subject to the requirements set forth in <br />the Design Standards. <br />There are several steps in the process that will commence following approval of the <br />rezoning and Development Stage Plan. These include, but are not limited to, <br />preparation and evaluation of the public improvement feasibility study, financial <br />analysis, operation and maintenance agreement and the development agreement. <br />These items will need to be completed and approved in conjunction with the final plan <br />approval. <br />Generally, the proposed development is consistent with the original Calthorpe Master <br />Plan and Design Standards. The Hartford Group has been very receptive to design <br />modifications to insure a high quality development. There are some further changes <br />and clarifications that need to be incorporated into the final plan as suggested in this <br />report. Additionally, design items such as the streetscaping element will go through <br />further modification and review as part of the Public Improvement Design process. <br />15 <br />
