City Council <br />Legacy at Woods Edge <br />March 8, 2004 <br />WHEREAS, the proposed Development Stage Plan and Preliminary Plat meets the <br />requirements of the City's zoning ordinance and subdivision ordinance subject to certain <br />conditions of approval. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Lino Lakes hereby <br />approves the 'Development Stage Plan for the Legacy at Woods Edge Project and the <br />Preliminary Plat titled Village No. 2 subject to the following conditions: <br />1. Approval of the Rezoning to Planned Unit Development. <br />Title work should be prepared to verify the status of existing roadway easements <br />i.e., public or private. If it is determined that they are public easements they shall <br />be vacated in accordance with city and state requirements. <br />3. A development phasing plan shall be submitted for review and approval by the <br />City. <br />A feasibility study shall be prepared for the installation of Public Improvements. <br />Such feasibility study shall include estimated costs and proposed assessments to <br />benefiting property owners. <br />Developer shall provide an Economic Feasibility Study of the proposed project <br />for review by the City. <br />Developer shall provide an Operation and Maintenance Agreement for the <br />development covering both Public and Private Improvements for review and <br />approval by the City. <br />Developer shall enter into a development contract with the City. <br />Acquisition by the City of parcels adjacent to the site required for proposed Lake <br />Drive improvements. <br />9. Requirements for project identity and signage will need to be established in <br />conjunction with final plan /final plat approval. <br />10. The proposed Lakes Drive improvements will be subject to review and approval <br />by Mn /DOT and Anoka County. <br />21 <br />
