CITY OF LINO LAKES RESOLUTION NO. 04-36 RESOLUTION AUTHORIZING THE ABATEMENT OF SPECIAL ASSESSMENTS ON PARCEL NUMBERS 30- 31 -22 -21 -0001 WHEREAS, the City of Lino Lakes in 1997 levied a special assessment in the amount of $586,602.29 on parcel number 30- 31 -22 -21 -0001, owned by Mr. George Reiling, for various improvements benefiting his property; and, WHEREAS, Mr. Reiling appealed the amount of said special assessment to U.S. District Court; and, WHEREAS, the U.S. District Court in 2001 reduced the amount of the assessment to $180,000.00; and, WHEREAS, the City of Lino Lakes, in compliance with the court order, abated all remaining special assessment payments from the year 2001 forward; and, WHEREAS, the special assessment installment for the year 2000 in the amount of $64,405.77, which should have been abated, remains outstanding against said parcel; and, WHEREAS, in order to avoid tax forfeiture of the parcel, the City Council of Lino Lakes wishes to abate such outstanding special assessment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes that the outstanding special assessment installment for 2000 in the amount of $64,405.77 on parcel no. 30- 31 -22 -21 -0001, Anoka County Fund No. 32608, is hereby abated. Adopted by the City Council of Lino Lakes, Minnesota, this 8th day of March, 2004.
