AGENDA ITEM 1C <br />STAFF ORIGINATOR Al Rolek <br />MEETING DATE March 8, 2004 <br />TOPIC Consider Resolution 04-36 Abating Special Assessments on Parcel <br />No. 30- 31 -22 -21 -0001 <br />VOTE REQUIRED Simple Majority (3/5) <br />BACKGROUND <br />In 1997, the City of Lino Lakes levied special assessments in the amount of $586,602.29 on <br />parcel number 30- 31- 22- 21- 0001, owned by Mr. George Reiling, for various improvements <br />benefiting his property. Mr. Reiling appealed the amount of the special assessment to U.S. <br />District Court. In 2001 the U.S. District Court reduced the amount of the assessment to <br />$180,000.00. The City, in compliance with the court order, abated all remaining special <br />assessment payments from the year 2001 forward. However, through an oversight, the special <br />assessment installment for the year 2000 in the amount of $64,405.77, which should have also <br />been abated, remains outstanding against the parcel. <br />The property is set to go tax forfeit due to the outstanding assessment against the property. To <br />avoid tax forfeiture of the parcel, the City Council needs to approve a resolution to abate the <br />outstanding special assessment. <br />This item is presented on the consent agenda as a housekeeping item. Approval of the resolution <br />is necessary to come into compliance with the court order. <br />It is the recommendation of staff that the City Council approve Resolution No. 04 -36 abating the <br />outstanding special assessment installment for 2000 in the amount of $64,405.77. <br />OPTIONS <br />Approve Resolution 04-36. <br />2.
