City Council <br />Summary of Ord. 04 -04 <br />June 28, 2004 <br />ATTACHMENT A (Resolution No. 04 -93) <br />A SUMMARY OF ORDINANCE NO. 04 -04 <br />CITY OF LINO LAKES <br />ORDINANCE NO. 04 -04 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LINO <br />LAKES BY REZONING CERTAIN REAL ESTATE FROM LB, LIMITED BUSINESS <br />DISTRICT AND PSP, PUBLIC SEMI - PUBLIC TO <br />PUD, PLANNED UNIT DEVELOPMENT <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />SECTION 1. FINDINGS <br />The City Council makes the following findings regarding the application for <br />rezoning the property described below, based on the factors listed in Section 2, <br />Subd.1 E of the Lino Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific <br />policies and provisions of and has been found to be consistent with the <br />official City Comprehensive Plan, as the site is guided for mixed use. <br />2. The proposed use is or will be compatible with present and future land <br />uses of the area. The site is guided for mixed use. Land in the area of <br />the site is already developed with commercial uses or designated for <br />such use. Subject to the conditions of site and building plan /conditional <br />use permit approval the site is compatible with existing commercial and <br />residential uses as well as future commercial and residential. <br />3. The proposed use conforms with all performance standards contained <br />within the city's zoning ordinance and is subject to the Design <br />Guidelines attached hereto. <br />4. The proposed use can be accommodated with existing public services <br />and will not overburden the City's service capacity. Existing sanitary <br />sewer and water services are available to the site and will not <br />overburden existing public services. <br />5. Traffic generation by the proposed use is within capabilities of streets <br />serving the property in conjunction with the public improvements <br />proposed. <br />
