1 <br />COUNCIL MEETING MARCH 13, 1989 <br />Wine License Request, Chomonix Golf Course - Mr. Hawkins <br />explained state statute require that wine licenses be issued <br />only to establishments with a seating capacity of 25 or more <br />serving food. The State also has a liberal interpretation of <br />food including such., items as stewart sandwiches and pizza. <br />These items are sold at the golf club. Mr. Hawkins noted <br />that the gold club meets the requirements and explained he <br />saw no reason to deny the license. <br />Mr. Pat Smith, 7002 West Shadow Lake Drive told the Council <br />that there are over 100 children in the area of the golf <br />course and noted that Anoka county has put the installation <br />of the club house access road from Lake Drive on hold. He <br />felt issuing the license could further endanger the children <br />and suggest that the Council approve the wine license <br />contigent upon the installation of the Lake Drive access <br />road. <br />Mr. Bisel suggested that the Council take a look at the <br />number of licenses this City can issue and noted this City <br />could see a real increase in requests. Mr. Hawkins explained <br />that there is a statutory limit on the number of licenses the <br />City could issue and suggested holding back one or two <br />licenses in the event a large hotel locates in the City. Mr. <br />Bisel said he felt this matter should be discussed and a <br />policy prepared. <br />Mayor Benson noted receipt of a letter from Mary Jones, 830 <br />Oak Lane regarding expansion to liquor facilities at Ross' <br />Corner Shoppe. <br />Mr. Neal moved to approve the wine license for the Chomonix <br />Golf Club. Mr. Bohjanen seconded the motion. Motion carried <br />with Mr. Bisel voting no. <br />Basement Acquisition, West Central Trunk Improvement - Mr. <br />Hawkins explained that he contacted the appraiser involved <br />with the original appraisals of the five Rustic Lane <br />properties and asked him to prepare appraisals for easement <br />acquisition on the five properties. Last Thursday he and Mr. <br />Stahlberg met with the five property owners and presented the <br />appraisals to them. The appraisals were not accepted by the <br />landowners and counter proposals from the landowners were <br />received. The landowners indicated that the first three <br />items on their proposal were not negotiable, however the <br />money issue was negotiable. <br />Mr. Hawkins recommended to the Council that a petition for <br />eminent domain action be filed with the court. The court <br />would appoint three independent individuals to hear <br />presentations by the landowners and the City. They would <br />make a determination regarding compensation for the <br />easements. <br />
