While the negotiations proceed, the City can <br />authorize the City Attorney to proceed with eminent domain <br />proceedings and the improvement project will not be delayed. <br />He felt by bowing to the demands a precedence would be set. <br />Mr. Bisel asked how the City got into this type of a <br />situation. Mr. Schumacher explained that this situation <br />began with the development of Woodridge Estates and the need <br />to bring the sewer and water lines to Woodridge Estates from <br />the north. Several locations had been proposed for the <br />easements and the Aras' agreed to allow the easement cross <br />their property. Since that time surveyors have established <br />the line. This was not acceptable to the Aras' and the line <br />was moved and they have not agreed to its location. Mr. <br />Bisel commented that the right -of -way issue should have been <br />finalized prior to the start of construction. <br />Mr. Neal moved to set a deadline for Friday, July 21, 1989 to <br />finalize negotiation and to begin the eminent domain <br />procedure. Mr. Hawkins suggested that the Council could <br />authorize the action for eminent domain proceedings at this <br />time since it will take several days to begin the paper work <br />involved. Mr. Bisel asked Mr. Schumacher to notify Mr. Aras <br />that the eminent domain proceedings have been authorized. <br />After further discussion, Mr. Neal withdrew his motion. <br />Mr. Bisel moved to authorize eminent domain proceedings on <br />this matter and to notify Mr. and Mrs. Aras in writing. Mr. <br />Bohjanen seconded the motion. Motion passed unanimously. <br />OLD BUSINESS <br />Update - D. Erickson's 2nd Addition Park - Mr. Schumacher <br />noted the letter from Bart Rehbein explaining that their <br />portion of the construction will be completed by August 1, <br />1989. <br />NEW BUSINESS <br />For Your Information - July 15, 1989 Chain of Lakes Regional <br />Park Event, rocking Hollywoods - Mr. Schumacher explained <br />that he has talked to Chief Campbell and he has not been able <br />to get much cooperation from the Anoka County Parks <br />Department regarding what has been done in the way of crowd <br />control, police protection, fire protection and health care. <br />They have told Chief Campbell that they will re- assign an <br />additional park ranger for duty at this park during this <br />event. Mr. Bisel said that he resents imposing this kind of <br />possible expense on the citizens of Lino Lakes. He asked <br />that the Police Department keep careful track of any time <br />spent in that area. Mr. Neal said that he was informed that <br />the Fire Department, if called, will only go as far as the <br />entrance to the Park. <br />
