COUNCIL MINUTES <br />AUGUST 27, 1990 <br />contingent upon receipt of the new easement documents and <br />approve Resolution No. 61 - 90. Council Member Kuether <br />seconded the motion. On a roll call vote, motion carried <br />unanimously. <br />Resolution No. 61 - 90 can be found at the end of these <br />minutes. <br />PUBLIC HEARING, ASSESSMENTS, WOODRIDGE ESTATES AND <br />SURROUNDING AREAS, RESOLUTION NO. 62 - 90 <br />Mr. Schneider told the Council that the improvements for this <br />area are nearly completed and the assessment for all parcels <br />has been calculated. The Clerk has a copy of the assessment <br />roll and the developers have also received a copy. <br />Mr. Schneider explained that the developer of Woodridge <br />Estates and the developer of Rohavic Oaks, Second Addition <br />have had many questions as to how the assessment was <br />calculated. He used the over head projector and gave a very <br />detailed explanation of how the assessment was determined. <br />Mayor Bisel opened the public hearing at 8:37 P.M. Mr. <br />Gordon Jensen, attorney for the developer of Woodridge <br />Estates presented a notice of objection to the assessment to <br />the Council. He noted that the objections to the assessment <br />are numerous and this objection was presented to preserve the <br />right of appeal. Mr. Jensen also explained that he was not <br />in a position to prove his objections this evening. <br />Mr. Jensen complimented Mr. Schneider for his presentation. <br />He noted that differences appear to be between the <br />feasibility report and the amount of the bids and the <br />commitment made by the developer in the Developers Agreement. <br />He expressed concern that the Developers Agreement is not - <br />being followed and also that the feasibility is based on 1988 <br />figures and the assessment is based on the current Public <br />Improvement Financing Policy. Mr. Jensen said he also had a <br />concern in trying to determine what portion of the costs <br />should be attributed to Woodridge Estates. He noted that Mr. <br />Schneider's presentation tonight did present a clearer <br />picture of what has occurred. <br />Mr. Jensen noted that the charge for Storm Water Management <br />has been deleted since Mr. Carlson has completed nearly all <br />of the work required in his subdivision. However, there is <br />about $50,000.00 to $60,000.00 in assessment charges that he <br />is unable to substantiate. <br />Mr. David Vickers, one of three partners in Rohavic Oaks, <br />Second Addition presented written objections to their <br />proposed assessment. <br />Ms. Connie Grundhofer, 235 Linda Avenue asked if her <br />PAGE 6 <br />
