COUNCIL MINUTES AUGUST 27, 1990 <br />assessment. He asked why those parcels that will be <br />developed at a later date are not being charged for right -of- <br />way. Mr. Schneider explained that when they do develop they <br />will be charged their share of right -of -way acquisition <br />costs. However, they never have been supporters of the <br />improvement and are not developing at this time. Without the <br />right -of -way no other parcels would have been able to <br />develop. Mr. Hawkins explained that is how all projects work <br />in the State of Minnesota. Right -of -way costs are <br />distributed over the entire project. <br />Mr. Vickers noted that the storm sewer for this area is now <br />spilling into the ponds and ditches in Rohavic Oaks First <br />Addition that was excavated by the developers. He explained <br />that he felt since the City was using a privately installed <br />system, his development should be credited. If this system <br />was not in place, another system would have had to be <br />installed adding additional costs to the improvement. He <br />asked why drainage could not be handled in a different manner <br />such as by using the road surface. Mr. Vickers asked for a <br />breakdown of where this four (.04) cents is going. Mr. <br />Schneider provided the breakdown. <br />Mr. Hawkins explained to the Council that they now have heard <br />objections and received the one (1) objection filed by a <br />developer. The Council can adopt a resolution approving this <br />assessment and meetings can continue with this developer to <br />determine if there are any errors. If errors are found, the <br />Council can hold a supplemental assessment hearing. This <br />hearing can be held at any time and adjustments to the <br />assessment can be made at any time. <br />Council Member Bohjanen moved to close the public hearing at <br />9:15 P.M. Council Member Kuether seconded the motion. <br />Motion carried unanimously. <br />Council Member Kuether moved to adopt Resolution No. 62 - 90 <br />and approve the assessment roll as presented. Council Member <br />Bohjanen seconded the motion. On a roll call vote, motion <br />carried unanimously. <br />Resolution No. 62 - 90 can be found at the end of these <br />minutes. <br />The Council took a five (5) minute break at 9:22 P.M. <br />PUBLIC HEARING, REZONE PINERIDGE ESTATES FROM SINGLE FAMILY <br />RESIDENTIAL (R -1X) TO PLANNED UNIT DEVELOPMENT (R -5), <br />ORDINANCE NO. 08 - 90, FIRST READING <br />Mr. Miller explained that at the July 23, 1990 Council <br />meeting, PineRidge was discussed at length.
